The instruments must include all of the <br />1358 following protections: <br />1359 (i) Commercial uses prohibited (for residential PUDs); <br />1360 (ii) Vegetation and topographic alterations other than <br />1361 routine maintenance prohibited; <br />1362 (iii) Construction of additional buildings or storage of <br />1363 vehicles and other materials prohibited; and <br />1364 (iv) Uncontrolled beaching of watercraft prohibited. <br />1365 3. Development organization and functioning. Unless an equally <br />1366 effective alternative community framework is established, <br />1367 when applicable, all residential planned unit developments <br />1368 must use an owners association with the following features: <br />1369 (i) Membership must be mandatory for each dwelling <br />1370 unit or site purchaser and any successive purchasers; <br />1371 (ii) Each member must pay a pro rata share of the <br />1372 association's expenses, and unpaid assessments can <br />1373 become liens on units or sites; <br />1374 (iii) Assessments must be adjustable to accommodate <br />1375 changing conditions; and <br />1376 (iv) The association must be responsible for insurance, <br />1377 taxes, and maintenance of all commonly owned <br />1378 property and facilities. <br />1379 b. Open space requirements. Planned unit developments must contain <br />1380 open space meeting all of the following criteria: <br />1381 1. At least 50 percent of the total project area must be preserved <br />1382 as open space; <br />1383 2. Dwelling units or sites, road rights -of -way, or land covered by <br />1384 road surfaces, parking areas, or structures, except water- <br />1385 oriented accessory structures or facilities, are developed <br />1386 areas and shall not be included in the computation of <br />1387 minimum open space; <br />1388 3. Open space must include areas with physical characteristics <br />1389 unsuitable for development in their natural state, and areas <br />1390 containing significant historic sites or unplatted cemeteries; <br />1391 4. Open space may include outdoor recreational facilities for use <br />1392 by owners of dwelling units or sites, by guests staying in <br />1393 commercial dwelling units or sites, and by the general public; <br />1394 5. Open space may include subsurface sewage treatment <br />1395 systems if the use of the space is restricted to avoid adverse <br />1396 impacts on the systems; <br />38 <br />
