1397 6. Open space must not include commercial facilities or uses, <br />1398 but may contain water -oriented accessory structures or <br />1399 facilities; <br />1400 7. The appearance of open space areas, including topography, <br />1401 vegetation, and allowable uses, must be preserved by use of <br />1402 restrictive deed covenants, permanent easements, public <br />1403 dedication and acceptance, or other equally effective and <br />1404 permanent means; and <br />1405 8. The shore impact zone, based on normal structure setbacks, <br />1406 must be included as open space. For residential PUDs, at <br />1407 least 50 percent of the shore impact zone area of existing <br />1408 developments or at least 70 percent of the shore impact zone <br />1409 area of new developments must be preserved in its natural or <br />1410 existing state. For commercial PUDs, at least 50 percent of <br />1411 the shore impact zone must be preserved in its natural state. <br />1412 c. Erosion control and stormwater management. Erosion control and <br />1413 stormwater management plans must be developed and the PUD <br />1414 must: <br />1415 1. Be designed, and the construction managed, to minimize the <br />1416 likelihood of serious erosion occurring either during or after <br />1417 construction. This must be accomplished by limiting the <br />1418 amount and length of time of bare ground exposure. <br />1419 Temporary ground covers, sediment entrapment facilities, <br />1420 vegetated buffer strips, or other appropriate techniques must <br />1421 be used to minimize erosion impacts on surface water <br />1422 features. Erosion control plans approved by a soil and water <br />1423 conservation district may be required if project size and site <br />1424 physical characteristics warrant; and <br />1425 2. Be designed and constructed to effectively manage <br />1426 reasonably expected quantities and qualities of stormwater <br />1427 runoff. Impervious surface coverage within any tier must not <br />1428 exceed 25 percent of the tier area, except that for commercial <br />1429 PUDs 35 percent impervious surface coverage may be <br />1430 allowed in the first tier of general development lakes with an <br />1431 approved stormwater management plan and consistency with <br />1432 this subdivision. <br />1433 d. Centralization and design of facilities. Centralization and design of <br />1434 facilities and structures must be done according to the following <br />1435 standards: <br />1436 1.
