1878 (1) The provisions of this subdivision shall apply only within the designated <br />1879 Scenic River Land Use District of the Rum River in accordance with the <br />1880 property descriptions contained in Minn. Rules pt. 6105.1400. <br />1881 <br />1882 (2) In their interpretation and application, the provisions of this subdivision shall <br />1883 be held to be minimum requirements, and shall not be deemed a limitation or <br />1884 repeal of any powers or rights granted by Minnesota Statutes. <br />1885 <br />1886 (3) It is not intended by this subdivision to repeal, abrogate, or impair any <br />1887 existing easement, covenants, deed restrictions, or land use controls. Where <br />1888 this subdivision imposes greater restrictions, the provisions of this subdivision <br />1889 shall prevail. <br />1890 <br />1891 (4) Compliance. The use of any land within the Scenic River Land Use District; <br />1892 the size and shape of lots; the use and location of structures on lots; the <br />1893 installation and maintenance of water supply and waste disposal facilities; the <br />1894 filling, grading, lagooning, or dredging of any river area; the cutting of <br />1895 vegetation or alteration of the natural topography within the district; and the <br />1896 subdivision of land shall be in full compliance with the terms of this <br />1897 subdivision and other applicable regulations. Permits from the zoning <br />1898 authority are required by this Code, for the construction of buildings, public or <br />1899 private water supply and sewage treatment systems, the grading and filling of <br />1900 the natural topography, and erection of signs within the Scenic River Land <br />1901 Use District of the Rum River. <br />1902 <br />1903 (5) The term "wetland" shall be as defined in Minn. Stats. § 103G.005, subd. 19. <br />1904 (Code 1978, § 9.23.03; Ord. No. 81-04, 8-18-1981; Ord. No. 86-2, 8-25-1986) <br />1905 Ses.1-7 261222, Di .ri <br />1906 (b) District application <br />1907 (1) The Scenic River Land Use District of the Rum River, within the city, is <br />1908 I divided into two areas}: The portion of the Scenic River Land Use District <br />1909 located within the 2000 Urban Area as defined and located in article II, <br />1910 division 3 of this chapter shall be classified as an urban area; and the <br />1911 remainder of the Scenic River Land Use District within the city shall be <br />1912 classified as a rural area. <br />1913 <br />1914 (2) The Scenic River Land Use District shall be shown on the official zoning <br />1915 map, as shall the urban and rural area portions of the district contained <br />1916 therein. <br />1917 <br />52 <br />
