2015 but may be waived by the zoning administrator when adequate data is <br />2016 already available. <br />2017 <br />2018 I (b2) Planned unit or cluster developments may be allowed in the Scenic River <br />2019 Land Use District if preliminary plans are first approved by the commissioner <br />2020 of natural resources and the applicable provisions of Minn. Rules pts. <br />2021 6105.0010-6105.0250 pertaining to such development are satisfied, and the <br />2022 provisions of this Code are satisfied. <br />2023 (Code 1978, § 9.23.09; Ord. No. 86-2, 8-25-1986) <br />2024 Sec -2602396and scape teratienc. <br />2025 (h) Landscape alterations <br />2026 (1) The vegetative cutting provisions of this section shall apply to those areas as <br />2027 I specified in section 117 256 subsection (d) of this section. <br />2028 (2) General provisions within designated setback areas: <br />2029 a. Clear -cutting, except for any authorized public services such as roads <br />2030 and utilities, shall not be permitted within 200 feet of the OHW. <br />2031 b. Selective cutting of trees in excess of four inches in diameter at <br />2032 breast height shall be permitted providing cutting is spaced in several <br />2033 cutting operations and a continuous cover is maintained. <br />2034 I c. The cutting provisions of subsections (ah)(2)a and b of this section <br />2035 shall not be deemed to prevent: <br />2036 1. The removal of diseased or insect infested trees or of rotten <br />2037 or damaged trees that present safety hazards. <br />2038 <br />2039 2. Pruning understory vegetation, shrubs, plants, brushes, <br />2040 grasses, or from harvesting crops, or cutting suppressed <br />2041 trees or trees less than four inches in diameter at breast <br />2042 height. <br />2043 (3) Clear -cutting. Clear -cutting anywhere within the Scenic River Land Use <br />2044 District of the Rum River is subject to the following standards and criteria: <br />2045 a. Clear -cutting shall not be used as a cutting method where soil, slope, <br />2046 or other watershed conditions are determined by the zoning authority <br />2047 to be fragile and subject to severe erosion and/or sedimentation. <br />2048 b. Clear -cutting shall be conducted only where clear-cut blocks, patches <br />2049 or strips are, in all cases, shaped and blended with the natural terrain. <br />2050 c. The size of clear-cut blocks, patches or strips shall be kept at the <br />2051 minimum necessary. <br />2052 d. Where feasible, all clear cuts shall be conducted between September <br />2053 15 and May 15. If natural regeneration will not result in adequate <br />2054 vegetative cover, areas in which clear -cutting is conducted shall be <br />57 <br />Formatted: Indent: Left: 1" <br />
