2055 replanted to prevent erosion and to maintain the aesthetic quality of <br />2056 the area. Where feasible, replanting shall be performed in the same <br />2057 spring or the following spring. <br />2058 (4) Grading, filling, alterations of the bed of public waters. Any grading and filling <br />2059 work done within the Scenic River Land Use District of this section shall <br />2060 require a permit and shall comply with the following: <br />2061 a. Grading and filling of the natural topography that is not accessory to a <br />2062 permitted or conditional use shall not be permitted in the Scenic River <br />2063 Land Use District. <br />2064 <br />2065 b. Grading and filling of the natural topography that is accessory to a <br />2066 permitted or conditional use shall not be conducted without a grading <br />2067 and filling permit from the zoning authority. A grading and filling <br />2068 permit may be issued only if the conditions of the following <br />2069 I subsections (lah)(4-4)c and d of this section are properly satisfied. <br />2070 <br />2071 c. Grading and filling of the natural topography which is accessory to a <br />2072 permitted or conditional use shall be performed in a manner which <br />2073 minimizes earthmoving, erosion, tree clearing, and the destruction of <br />2074 natural amenities. <br />2075 <br />2076 d. Grading and filling in of the natural topography shall also meet the <br />2077 following standards: <br />2078 1. The smallest amount of bare ground is exposed for as short a <br />2079 time as feasible. <br />2080 2. Temporary ground cover such as mulch is used and <br />2081 permanent ground cover such as sod, is planted. <br />2082 3. Methods to prevent erosion and to trap sediment are <br />2083 employed. <br />2084 4. Fill is stabilized to accepted engineering standards. <br />2085 <br />2086 (5) Excavation of material from, or filling in a wild, scenic or recreational river, or <br />2087 construction of any permanent structures of navigational obstructions therein <br />2088 is prohibited unless authorized by a permit from the commissioner of DNR <br />2089 pursuant to Minn. Stats. § 103G.245. <br />2090 <br />2091 (6) Drainage or filling in of wetlands is not allowed within the Scenic River Land <br />2092 Use District designated by this subdivision. <br />2093 <br />2094 (7) Utility transmission lines. All utility transmission crossings of land within the <br />2095 Scenic River Land Use District designated by this subdivision shall require a <br />58 <br />
