2096 conditional use permit. The construction of such transmission services shall <br />2097 be subject to the standards and criteria of Minn. Rules pt. 6105.0170. No <br />2098 conditional use permit shall be required for high voltage transmission lines <br />2099 under control of the environmental quality council pursuant to Minn. Stats. § <br />2100 216E.10. <br />2101 <br />2102 (8) Public roads. In addition to such permits as may be required by Minn. Stats. <br />2103 § 103G.245, a conditional use permit shall be required for any construction or <br />2104 reconstruction of new public roads within the Scenic River Land Use District <br />2105 of this subdivision. Such construction or reconstruction shall be subject to the <br />2106 standards and criteria of Minn. Rules pt. 6105.0200. A conditional use permit <br />2107 is not required for minor public streets that are streets intended to serve <br />2108 primarily as an access to abutting properties. Public roads include township, <br />2109 county, and municipal roads and highways that serve or are designed to <br />2110 serve flows of traffic between communities or other traffic generating areas. <br />2111 (Code 1978, § 9.23.10; Ord. No. 81-04, 8-18-1981; Ord. No. 86-2, 8-25-1986) <br />2112 Sec. 117 261240. Administration. <br />2113 (i) Administration <br />2114 Organization provisions. <br />2115 (1) The provisions of this subdivision shall be administered by the city's zoning <br />2116 authority. <br />2117 (2) The board of adjustment shall act upon all questions as they arise in the <br />2118 administration of this subdivision, to hear and decide appeals; and to review <br />2119 any order, requirement, decision or determination made by the zoning <br />2120 authority, who is charged with enforcing this subdivision as provided by <br />2121 Minnesota Statutes. <br />2122 <br />2123 (3) Permit fees and inspection fees as may be established by ordinance shall be <br />2124 collected by the zoning authority for deposit with the city and credited to the <br />2125 appropriate general fund. <br />2126 <br />2127 (4) Substandard lots and uses, nonconforming uses. <br />2128 a. Substandard lots. <br />2129 1. Lots of record in the office of the county recorder on the <br />2130 effective day of enactment of this subdivision that do not meet the <br />2131 dimensional requirements of this Code shall be allowed as building <br />2132 sites; provided that such use is permitted in the land use district; the <br />2133 lot was in separate ownership from abutting lands on the date of <br />2134 enactment of this Code; and all sanitary and dimensional <br />2135 requirements are complied with to the greatest extent practicable. <br />59 <br />
