a split of his five acre parcel into one one-acre parcel and one four-acre <br />parcel. Mr. Fischer stated that if Council does not approve the subdivision, <br />the selling price of that land to the City in the future will reflect his <br />additional costs incurred by having to refinance the entire parcel of property. <br />Mr. Fischer did not have an explanation for creating a landlocked parcel. <br /> <br />Councilmember Cox stated that he doesn't foresee the City purchasing this <br />property and that having any bearing on the case. <br /> <br />Motion by Councilm~nber Cox and seconded by Councilmember Reimann to deny Mr. <br />Fischer's request for a metes and bounds subdivision based on the fact that the <br />proposed subdivision would create a landlocked parcel. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox and <br />Reimann. Voting No: None. Absent: Councilm~nber Schlueter. <br /> <br />Motion by Councilmember Cox and seconded by Mayor Heitman, for discussion, to <br />authorize the Mayor and City Administrator to enter into a develolmnent <br />agreement with Mr. Len McLaughlin of M&S Develounent for site improvements for <br />the Churchill Estates apartment project in the Oxbow Addition. <br /> <br />Further Discussion: Mayor Heitman expressed concern for term 'best efforts' <br />used on page 7 of the develoEment agreement. Mr. Hartley stated that 'best <br />efforts' is a legal term. Mayor Heitman expressed concern with language on <br />page 13 regarding construction plans not being rejected due to any objection <br />which could have been raised upon review of the Preliminary Plans and corrected <br />more economically at that time. Mayor Heitman inquired if there is sufficient <br />time to raise challenges prior to their having gone through the process. Mr. <br />Hartley replied that there is. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, COx and <br />Reimann. Voting No: None. Absent: Councilmember Schlueter. <br /> <br />Mr. Raatikka stated that the estimated project cost is $272,900. ~he City <br />would be assessing $19,500 and utilizing MSA funds for the balance of the <br />project. ~he access onto Hwy. #10 has not been finalized. Reoommend <br />proceeding with the project. <br /> <br />Motion by Councilmember COx and seconded by Mayor Heitman to adopt Resolution <br />#86-54 accepting the feasibility report for the extension of 153rd Avenue NW <br />from P~na Street NW to Andrie Street NW and calling for a public hearing at <br />7:45 p.m. on April 22, 1986. (Please refer to resolution file for Resolution <br />#86-54). <br /> <br />Motion carried. Voting Yes: <br />Reimann.
