Mr. Hartley referred to Case #25 (Consideration of gambling license <br />application for Pheasants Forever) and stated that Council had 30 days to <br />oppose the gambling license application; that 30 days has elapsed. <br /> <br />Motion by Councilmember Schlueter and seconded by Councilmember Sorteberg to <br />approve the agenda with the following adjustment: <br /> <br />1. Voting No: None. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #17: <br /> <br />Request For Conditional Use Permit To CQDstruct A Mim£ Storage <br />Facility And Variance To Exceed Maximum Imperviou~ Surface <br />Coverage At 13760 Ebony Street NW; Case Of Mr,.Bill Dubats: <br /> <br />Mr. Dubats was present and stated that at the time P&Z reviewed his case, it <br />was not a known fact that Ebony Street does have storm drainage. Mr. Dubats <br />stated that he would still be willing to submit a storm drainage plan to the <br />City Engineer for approval. <br /> <br />Motion by Councilmember Reimann and seconded by Councilmember Schlueter to <br />adopt Findings of Fact 0134 relating to Mr. Bill Dubats' request for a <br />conditional use permit. (Refer to findings of fact file for Findings of Fact <br />0134). <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Motion by Councilmember Reimann and seconded by Councilmember Cox to approve <br />Mr. Bill Dubats' request for a conditional use permit to construct a mini <br />storage facility and variance to exceed the maximum impervious surface coverage <br />at 13760 Ebony Street NW, contingent upon DNR approval and the City Engineer's <br />approval of the storm water management plan for the site and upon the applicant <br />entering into a conditional use permit agreement with the City. <br /> <br />Further Discussion: Mr. Dubats referred to language in the permit agreement <br />that states the permit and variance 'are subject to review at any time and <br />shall be reviewed annually by City Staff.' Mr. Dubats inquired as to the <br />intent of this language. Mr. Goodrich replied that the language is standard; <br />the City wants the right to review the property, not necessarily at any time, <br />after receipt of complaint or indication of violation and on an annual basis. <br />Mr. Goodrich stated that if property reviewal reveals a violation of the permit <br />conditions, the permit holder is subjected to a review hearing and if the <br />violation continues, the City can revoke the permit. Mr. Goodrich stated that <br />language stating 'at any reasonable time' could be substituted for 'at any <br />time'. Mr. Dubats referred to Item #6 which requires limited outside storage <br />and that screening be provided; inquired why he is being subjected to higher <br />operating standards than other businesses in the area. Mr. Goodrich stated <br />that the City's ordinance addresses outside storage and Mr. Dubats is not being <br />singled out.
