Norris stated that time limits on home occupation permits is allowed; the <br />request and permit to which Councilmember Cox referred to expires in 1988. <br /> <br />Mr. Goodrich stated that State statutes say that conditional use permits are <br />perpetual and conditions can be placed on them; one of the conditions can be a <br />time limit. <br /> <br />Motion by Councilmember Reimann and seconded by Councilmember Cox to adopt <br />Findings of Fact 0136 relating to Mr. Robert Cox' request for a conditional use <br />permit. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Motion by Councilmember Reimann and seconded by Councilmember Cox to deny Mr. <br />Robert Cox' request for a conditional use permit to operate a small engine <br />repair business from his home based on the findings of fact and the City's <br />attempt to place business uses in the appropriate zones. <br /> <br />Further Discussion: Mr. Robert Cox stated that an expiration date on the <br />permit was his idea; he wants the opportunity to get his business established <br />before moving to a business zone. Councilmember Cox noted that the City has an <br />Economic Development Commission working to stimulate development in the <br />business district; Mr. Robert Cox should approach EDC for assistance in <br />locating his business to an affordable location in an appropriate zone. Mr. <br />Robert Cox noted that his neighbors have not voiced any opposition to the <br />permit request. Mayor Heitman inquired if the City is creating a double <br />standard by approving some similar requests, i.e., Connie Skarbakka. Mr. <br />Goodrich replied that Council has to consider the findings of fact and make <br />case by case decisions. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox, <br />Reimann and Schlueter. Voting No: None. <br /> <br />Case #4: Extension Of 153rd Avenue NW From Puma Street NW To Andrie <br /> Street NW: <br /> <br />Mr. Raatikka stated that the District State Aid Engineer is reviewing the <br />situation hoping to come up with an appropriate terminus for 153rd on Hwy. 10. <br />Staff recommends proceeding with the project and in the event the MSA <br />designation is not approved, the developer will be responsible for engineering <br />and construction costs of the road. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Reimann to order <br />plans for the extension of 153rd Avenue NW from Puma Street NW to Andrie Street <br />NW contingent upon the developers of Northfork waiving the 60 day waiting <br />period and depositing an excrow with the City in an amount established by the <br />City Engineer for the cost of preparation of these plans, and if the extension <br />is designated as an MSA street, the City will return the developer's escrow. <br /> <br />Further Discussion: Councilmember Schlueter inquired if this motion is also <br />intending that the developer will be paying for road construction.
