Motion by Councilmember Sorteberg and seconded by Councilmember Cox to adopt <br />the following amended Findings of Fact #0143 as they relate to Mrs. Cheri <br />Rice's request for a conditional use permit to operate a tuxedo rental business <br />from her home at 15210 Waco Street N.W.: <br /> <br />1. That Gary and Cheri Rice, hereinafter referred to as the "Applicants", <br />have properly applied for a conditional use permit to operate a tuxedo <br />rental business from their home at 15210 Waco Street N.W. <br /> <br />2. That the Applicants appeared before the Planning and Zoning Commission <br />for a public hearing pursuant to Section 170.016 of the City Code on July <br />8, 1986 and said public hearing was properly advertised and minutes of <br />public hearing are hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located <br />at 15210 Waco Street N.W. and is legally described as follows: <br /> <br />The West 217.8 feet of the East 435.6 feet of the South 200 feet of <br />the North 633 feet of the West Half of the Southeast Quarter of <br />Section 24, Township 32, Range 25, Anoka County, Minnesota as <br />measured along the North and East line of said West Half of Southeast <br />Quarter (subject to an easement for roadway purposes over the East 33 <br />feet thereof). <br /> <br />4. That the subject parcel is approximately 1 acre in size and is located <br />in the UER Urban Existing Residential district. <br /> <br />5. That the property is zoned UER Urban Existing Residential and a tuxedo <br />rental business is not a permitted use in this district. <br /> <br />6. That the adjoining properties are zoned UER Urban Existing <br />Residential. <br /> <br />7. That there are no other similar permitted uses in the UER Urban <br />Existing Residential district. <br /> <br />8. That there would be a significant increase in traffic flow to the area <br />because of UPS truck deliveries and unfamiliar vehicular traffic in the <br />neighborhood. <br /> <br />9. That the proposed use could be detrimental to persons living in that <br />area or to the general public and could impair the enjoyment of other <br />properties in the area because of additional traffic coming into the <br />neighborhood. <br /> <br />10. That the Applicant's request to operate a tuxedo rental business from <br />their home could be detrimental to the health, safety or general welfare <br />of the public because of the additional traffic. <br /> <br />11. That the proposed use will not be unsightly or obnoxious. <br /> <br />12.
