grant it. <br /> <br />Further Discussion: Mr. Goodrich informed Council that they are voting on the <br />amended findings of fact before them -- not on any preconceived notions. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox and <br />Schlueter. Voting No: None. <br /> <br />Mr. Goodrich stated that now Council should consider a conclusion to either <br />approve or disapprove the request for a conditional use permit based on the <br />findings of fact just adopted and not based on what Council heard before <br />regarding the case or what Council wants or any preconceived notions. <br /> <br />Councilmember Cox stated that he is not in favor of any business being operated <br />from a home because of the additional traffic it brings to a neighborhood, <br />especially a neighborhood developed in one acre lots. Mrs. Rice has the same <br />opportunities as Mr. Root; Mr. Root is being required to do things like <br />surfacing the parking area and he is expected to get into compliance. <br /> <br />Ms. Gislason inquired if there is anything her client can do, short of <br />withdrawing the request, to address Council's concerns. <br /> <br />Councilmember Cox replied that not bringing in additional traffic to a <br />residential neighborhood would address his concerns. Councilmember Cox stated <br />that people in R-1 areas have made it very clear that their homes are difficult <br />to sell because of zoning issues, i.e., businesses being operated in the <br />neighborhood. <br /> <br />Ms. Gislason inquired as to how accounting and word processing businesses can <br />be operated in residential areas without causing an increase in traffic to the <br />neighborhood. <br /> <br />Councilmember Cox replied that in both of those cases, the applicants indicated <br />that they go to their clients rather than the clients coming to their home; one <br />of those cases was even tabled until the applicant could be present to discuss <br />Council concerns. Councilmember Cox stated that he is 100% supportive of <br />anybody being in free enterprise but at the same time we have those people <br />living by certain rules and paying the freight, we create unfair competition <br />for them. <br /> <br />Mr. Goodrich reminded Council that they have to make a decision based on the <br />findings of fact. <br /> <br />Councilmember Cox stated that he believes in being fair and giving people the <br />opportunity to put their businesses together in a way that will sustain a <br />livelihood for them. <br /> <br />Mrs. Rice noted that a comment was made earlier regarding Mr. Roots' case being <br />different from hers and now the comment has been made that she has the same <br />opportunities as Mr. Root. <br /> <br />Councilmember Cox stated that the City is expecting Mr. Root to do a lot of <br />things, like surfacing his parking area, in order to be able to operate his <br /> August 26, 1986 <br /> <br />Page 18 of 25 <br /> <br /> <br />
