Voting No: None. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember $chlueter to approve <br />the request by Berndt Development Company for a conditional use permit to move <br />a residential garage, that meets with the City Building Inspector's approval, <br />into a B-1 Business District for commercial use at 6159 Hwy. #10 N.W. <br /> <br />Further Discussion : Mayor Reimann inquired as to the amount of performance <br />bond that should be required. <br /> <br />Councilmembers Cox and Schlueter amended the motion to include requiring a $500 <br />performance bond. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />$chlueter and DeLuca. Voting No: None. <br /> <br />Councilmember Schlueter noted that the motion to adopt the findings of fact <br />refers to amended findings of fact; it was the conditional use permit agreement <br />and not the findings of fact that had amendments to Items #3 and #5. <br /> <br />Council consensus was the that the findings of fact were adopted as presented <br />and not as amended. <br /> <br />Request For Preliminary Plat ApDroVal"Of'Autumn'M~d~ws~'Ca~e Of <br /> Mr. Ken Johnson: <br /> <br />Mr. Johnson and his son-in-law were present. <br /> <br />Ms. Norris recalled that on September 30, 1986 Council tabled Mr. Johnson's <br />request for preliminary plat approval until he could provide a 66' easement <br />for a future second access to the plat to be used for emergency services if <br />necessary. <br /> <br />Mr. Goodrich stated that there is an easement to the north of Mr. Johnson's <br />plat; it is a private easement and would require being deeded to the City. <br /> <br />Mayor Reimann stated that it was his understanding that by this meeting Mr. <br />Johnson was supposed to have approached owners of the private easement <br />regarding making it a public easement. <br /> <br />Mr. Johnson stated that he thought the City just wanted to be sure there was an <br />easement there that could be used in cases of emergency. <br /> <br />Mayor Reimann stated that the City wants a public easement to be developed as a <br /> October 28, 1986 <br /> <br />Page 9 of 21 <br /> <br /> <br />
