Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and
Cich. Voting No: None.

Case #7: Discussion Regarding Park Dedication For John Gobernatz Minor
Subdivision:

Mr. Banwart stated that the main concern with the current park dedication ordinance is that the
park dedication requirement refers to subdivisions and includes resubdivisions. City Staff has
determined that since Mr. Gobernatz' minor subdivision was approved by the Planning
Commission prior to the adoption of the new park dedication ordinance, his park dedication
requirement could be determined based on the previous ordinance. Under the previous
ordinance, Mr. Gobernatz would be obligated to pay park dedication on the building permit issued
for the new lot. Any future resubdivision of the property would be subject to the current
ordinance regarding park dedication.

Mr. Gobernatz stated that he is willing to pay his fair share of park dedication; that he is willing
to be considered under the ordinance but he does not want to pay park dedication on a recurring
basis. Mr. Gobernalz stated that he has contacted the attorney at the League of Minnesota Cities
and in their opinion, recurring park dedication fees is unusual.

Mr. Goodrich noted that State statute allows cities to charge park dedication anytime there is a
subdivision.

Motion by Councilmember DeLuca and seconded by Councilmember Pearson directing City Staff
to research park dedication requirements at the League of Minnesota Cities and report back to
City Council on January 24, 1989. At that time, there should also be information available
from the Park and Recreation Commission regarding park dedication.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and
Cich. Voting No: None.

Case #8: Response To Anoka County Court System Regarding Relocating
Municipal Trials:

Mr. Goodrich stated that the Anoka County Court Administrator has determined that all
municipal court trials, except those for the City of Anoka, will be conducted at the Columbia
Heights facility. The additional distance for officers and city attornies to travel impacts the
time and cost involved in court trials.

Motion by Councilmember DeLuca and seconded by Councilmember Cich directing that the Mayor
forward a letter to the Anoka County Chief Judge, Anoka County Clerk of Court and Anoka County
Commissioner Steffen expressing Ramsey's disappointment with the determination that all
municipal trials will be conducted at the Columbia Heights facility.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and

City Council/January 10, 1989
