Further Discussion: Councilmember DeLuca hesitated to enter into an agreement for a <br />private crossing prior to knowing liability insurance costs. Mr. Hartley stated that the <br />issue of whether or not to maintain the private crossing based on insurance costs is <br />present regardless if the City enters into an agreement for the crossing or not; the only <br />thing the private crossing agreement does is permit the City to move forward with the <br />construction of the crossing at 153rd. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, DeLuca and <br />Cich. Voting No: None. Abstain: Councilmember Pearson. <br /> <br />Mr. Hartley directed Mr. Raatikka to research the validity of State tax costs itemized on <br />the Construction and Maintenance Agreement for the 153rd Avenue crossing. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to <br />authorize the Mayor and City Administrator to enter into the Construction and <br />Maintenance Agreement for the 153rd Avenue N.W. crossing with Burlington Northern <br />Railroad and submit the required payments subject to the approval by the City Attorney <br />and Mn/DOT. <br /> <br />Further Discussion: Councilmember DeLuca inquired if the MSA funding has been <br />approved for the 153rd Avenue crossing. Mr. Raatikka replied that the plans and <br />agreement were submitted to Mn/DOT for review and their response was agreeable. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, <br />Peterson and Cich. Voting No: None. <br /> <br />CONSENT AGENDA <br /> <br />14. <br /> <br />Approve change order no. 4 to Cottonwood Construction for Project #88-16 <br />(Central Park Warming House) <br /> <br />15. <br /> <br />Adopt resolution approving pay estimate no. 5 to Cottonwood Construction for <br />Project #88-16. <br /> <br />Mr. Raatikka stated that the change order reduction amount noted in the agenda should be <br />changed from $761 to $1211; final cost of the project is $111,540.00 rather than <br />$111,990.00. Accordingly, pay estimate no. 5 (final) will change from $9,606.84 to <br />$9,156.84. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich to approve <br />change order no. 4 and adopt Resolution #89-01-14 approving pay estimate no. 5 <br />(final) to Cottonwood Construction, Inc. for Project #88-16 (Central Park Warming <br />House). <br /> <br />Motion carried.
