CASE # <br /> <br />REQUEST TO REZONE PROPERTY FROM B-1 BUSINESS AND R-1 SINGLE <br />FAMILY RESIDENTIAL TO R-1 SINGLE FAMILY RESIDENTIAL, R-3U <br />RESIDENTIAL, AND MULTIPLE RESIDENTIAL; <br /> CASE OF ROYAL OAKS REALTY, INC. <br /> By: Principal Planner, Patrick Trudgeon <br /> <br />Background: <br /> <br />Royal Oaks Realty has submitted an application to rezone property located at the southwest <br />corner of CSAH 5 (Nowthen Blvd.) and Dysprosium Street from B-1 Business and R-1 Single <br />Family Residential to R-1 Single Family Residential,' R-3U Residential, and Multiple <br />Residential. The rezoning would allow the property to be subdivided for 88 single-family lots, <br />91 townhome units and 82 senior apartment units. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />e) <br />f) <br /> <br />Site Location Map <br />Proposed Preliminary Plat dated December 11, 2001 <br />Existing Zoning Map of development area and surrounding area <br />Drawing showing proposed zoning districts on development <br />December 11, 2001. <br />2001 Land Use Map of development area <br />Proposed Findings of Fact <br /> <br />property dated <br /> <br />Notification: <br /> <br />State law requires that the City notify property owners within 350 feet be notified. Property <br />owners located within 700 feet were notified of the proposed rezoning. <br /> <br />Observations: <br /> <br />The property is 86.71 acres in size and is within the Metropolitan Urban Service Area (MUSA). <br />The preliminary plat accompanying the application proposes to develop 88 single family homes <br />on the western part of the property, 91 townhomes along Nowthen Blvd., and a 82 unit senior <br />apartment building along Dysprosium St. The 2001 Comprehensive Plan identifies this area as <br />being High Density Residential along Dysprosium St., Medium Density Residential along <br />Nowthen Blvd. and Low Density Residential on the western part of the property. <br /> <br />The development property is adjacent to property that is zoned R-1 Single Family Residential, <br />with the exception of a parcel north of the development property that is zoned R-3 Urban <br />Residential, and a portion of the Flintwood Hills P.U.D. that is adjacent to the southeast portion <br />of the development property. The Lord of Life Church property lying on the northeast, side of <br />Nowthen Blvd. is zoned B-1 Business and the Savannah Oaks Senior Apartment Building on the <br />eastern side of Dysprosium is zoned Multiple Residential. <br /> <br /> <br />
