Certification From <br />The National Arbor Day Foundation: <br /> <br />Mr. Banwart reported that he has researched and there is no fee charged to cities applying <br />for Tree City U.S.A. Certification from the National Arbor Day Foundation. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to authorize <br />application for the Tree City U.S.A. Certification from the National Arbor Day Foundation. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case #16: Estate of Daniel Laws Condemnation Action: <br /> <br />Mr. Goodrich stated that the City initiated a condemnation action against the Daniel Laws <br />estate in order to acquire the water tower parcel and right-of-way for the extension of <br />Dysprosium Street N.W. The Court appointed Commissioners awarded Daniel Laws <br />$57,800 based on the City's appraisal of $41,500; the additional $16,300 represents the <br />Commissioners award of severance damages for a 3.78 tract of land. Mr. Goodrich noted <br />that the City deposited $35,000 with the District Court at the initial stage of condemnation <br />action. Mr. Goodrich stated that it would be very costly to appeal the award and it is in the <br />City's best economic interest to accept the Commissioners award. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich to accept the <br />Condemnation Commissioners award filed August 21, 1989 in total amount of $57,800.00 <br />and direct the Finance Officer to issue a check to the property owner, less amounts <br />previously deposited with District Court at the initial stages of this condemnation action. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #17: Review Policies Relating To Facility Usage: <br /> <br />Mr. Hartley stated that the policies relating to facility usage are up for review as a result of <br />Boy Scout Troop 362's request for a waiving of the usage fee. City Council reviewed <br />those resolutions setting policies for usage of the Ramsey Municipal Center and the <br />Community Sign. Mr. Hartley reported that there is not a resolution in place regarding <br />usage of the Park Center Building at Central Park but the guidelines used are similar to <br />those established for the Municipal Center. <br /> <br />City Council directed City Staff to prepare resolution amendments to waive facility usage <br />fee for those groups or organizations consisting predominantly of school age children. <br /> <br />City Council/September 26, 1989 <br /> Page 12 of 14 <br /> <br /> <br />
