Case #5: <br /> <br />Request For Final Plat Approval Of Crooked Oak Addition; <br />Case Of John Schutz: <br /> <br />Mark Banwart stated that Crooked Oak Addition is a minor subdivision of 4.6 acres into <br />two lots. The hardship variance to lot size and soils concerns are addressed in the <br />development agreement. City Staff recommends final plat approval of Crooked Oak <br />Addition. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Peterson to adopt <br />Resolution #89-10-286 approving the final plat of Crooked Oak Addition. <br /> <br />Motion carded. Voting Yes: Acting Mayor DeLuca, Councilmembers Pearson, Cich and <br />Peterson. Voting No: None. Absent: Mayor Reimann. <br /> <br />Case #6: <br /> <br />Request For Final Plat Approval Of Gordon's Gardens 2nd <br />Addition; Case of Harley A. Gordon: <br /> <br />Mark Banwart stated that initially, Gordon's Gardens 2nd Addition was proposed to be a <br />minor subdivision; then it was revised to a full subdivision; it is presently proposed as a <br />minor subdivision again to create two new lots. The plat has been reviewed by the <br />Planning and Zoning Commission and the Park and Recreation Commission; City Staff <br />recommends final plat approval. <br /> <br />Acting Mayor DeLuca stated that Gordon's Gardens 2nd Addition is an example of where <br />not having road easements to property boundaries can cause problems. <br /> <br />Mark Banwart noted that even if there were easements in place that would allow <br />development of access to Gordon's Gardens 2nd Addition, the developer has indicated that <br />a full subdivision would have been cost prohibitive because of the length of road that <br />would have been required as compared to the number of lots that could have been <br />developed. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to adopt <br />Resolution #89-10-287 to approve the final plat of Gordon's Gardens 2nd Addition. <br /> <br />Motion carried. Voting Yes: Acting Mayor DeLuca, Councilmembers Pearson, Cich and <br />Peterson. Voting No: None. Absent: Mayor Reimann. <br /> <br />Case g7: Release Of Northfork PUD Financial Guarantees: <br /> <br />Mark Banwart explained that the intent of the letter of credit for Northfork was for the 1st <br />Addition and not the entire PUD. Based on that and the fact that the City received a letter <br />from Hakanson Anderson accepting the streets as conforming to the City's standards, the <br />City Staff is recommending that the City release the subdivision bond. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Cich to adopt <br />Resolution #89-10-288 releasing the Subdivision Bond Number C524100 for the <br />Northfork PUD. <br /> <br />City Council/October 24, 1989 <br /> Page 10 of 16 <br /> <br /> <br />
