COUNCIL BUSINESS <br /> <br />Case #1: Request For A Conditional Use Permit Amendment To Have <br /> An Apartment In A Church; Case Of Jehovah Witness Kingdom <br /> Hall: <br /> <br />Planning Assistant Sylvia Frolik noted that Dwight Ekwall is present representing the <br />Jehovah Witness Kingdom Hall. The Kingdom Hall is requesting a conditional use permit <br />amendment to have an apartment in the lower level of the facility in order to accommodate <br />the District Minister on his visits to the area. The apartment would be used 2-3 days a <br />week, 12 weeks a year. The Planning and Zoning Commission has recommended <br />approval of the request based on their opinion that pastors living in or about the church <br />premises is a historical practice. The Planning Commission also referred to the City's past <br />action to deny a permanent residence above a B-1 Business and noted that the proposed <br />apartment in Kingdom Hall is very temporary in nature in comparison. <br /> <br />Sylvia Frolik also noted that City Staff reviewed the proposed conditional use permit and is <br />suggesting for safety purposes that the certificate of occupancy for the apartment not be <br />issued until the facility is connected to municipal water and a sprinkler system is provided <br />for. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to adopt <br />Findings of Fact #0264 relating to the Jehovah Witness Kingdom Hall's request for a <br />conditional use permit amendment to have an apartment in the lower level of the facility. <br /> <br />Motion carded. Voting Yes: Acting Mayor DeLuca, Councilmembers Pearson, Cich and <br />Peterson. Voting No: None. Absent: Mayor Reimann. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to approve <br />the Jehovah Witness Kingdom Hall's request for a conditional use permit amendment to <br />maintain an apartment in the lower level of the church facility located at 13751 Dolomite <br />Street N.W. Further, that the conditional use permit shall be executed in accordance with <br />the Building Official's determination as to the appropriate timing for issuance of the <br />certificate of occupancy as it relates to the facility connecting to municipal water services <br />and providing for a sprinkler system. <br /> <br />Motion carried. Voting Yes: Acting Mayor DeLuca, Councilmembers Pearson, Cich and <br />Peterson. Voting No: None.
