#10 N.W. at which he intends to operate an automobile sales business and <br />continue to rent the two existing homes on the property. <br /> <br />The Commission noted that there should not be any vehicles parked for <br />display purposes in the 50' setback of Hwy. #10 right-of-way; that they <br />would not be in favor of Mr. Simons' layout intending automobile displays <br />in front of the existing structures on the property. <br /> <br />Ms. Norris stated that the setback requirements apply to permanent <br />structures; in B-1 areas, Hamsey's policy has been that parked vehicles are <br />not permanent structures and encroachment of the right-of-way has been <br />allowed. <br /> <br />The Commission proceeded to review the proposed findings of fact and make <br />the following amendments: <br /> <br />Item #9 - Change to read as follows: 'That the proposed use may be <br /> unduly dangerous or detrimental to persons residing or working in <br /> the vicinity.' <br /> <br />Add Item #18 - That the applicant intends to display vehicles for sale <br /> within the setback. <br /> <br />Add Item #19 - That the applicant intends to continue residential use <br /> of the homes existing on the property. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Shumway to adopt <br />findings of fact 0149, as amended, relating to a request by Mr. Steve <br />Simons for a conditional use permit to operate an automobile sales business <br />in the I-1 Industrial District. <br /> <br />Motion carried. Voting Yes: <br />Shumway, LaDue and Hendriksen. <br />Zimmerman and Howell. <br /> <br />Chairman Peterson, Commissioner Deemer, <br />Voting No: None. Absent: Commissioners <br /> <br />Chairman Peterson and Commissioner Deemer expressed concern with the access <br />onto Hwy. #10, display of vehicles in the setback and the continued <br />residential use of the property. <br /> <br />Motion by Commissioner Deemer and seconded by Chairman Peterson to <br />recommend denial of the request by Mr. Steve Simons for a condtional use <br />permit to operate an automobile sales business in the I-1 Industrial <br />District at 7205 to 7210 Hwy. #10 N.W. <br /> <br />Motion carried. Voting Yes: <br />Shumway, LaDue and Hendriksen. <br />'Zimmerman and Howell. <br /> <br />Chairman Peterson, Commissioners Deemer, <br />Voting No: None. Absent: Commissioners <br /> <br />Case #3: Request For Metes And Bounds Subdivision; Ca~e Of M~, <br /> <br />Mr. Barthold stated that he is requesting a metes and bounds subdivision of <br />a 5 acre parcel with 210' of frontage on Hwy. #47; his son resides on the <br /> Planning & Zoning/November 5, 1986 <br /> <br />Page 4 of 7 <br /> <br /> <br />
