Development Co.. Inc.

Mr. Berndt explained that he owned the property at 6159 Highway 10 and leased
it out for a truck sales operation. Mr. Berndt stated that the existing garage
on the property is in poor repair; he would like to move in a better one to
replace it. The garage to be moved in would be located behind the house;
eventually (after this winter), the existing garage would be destroyed. The
new garage would have footings and would be used for the clean up of vehicles
to be sold; the garage would not be used for customers' vehicle repairs.
Chairman Peterson stated that he didn't have a problem with the building being
used for that; he was concerned if the building was to be used for office
space. He also asked Mr. Berndt if he had any plans for the property. Mr.
Berndt replied that he would like to eventually surface the parking area; the
property needs a lot of repair.

The Commission agreed that Finding #7 should be amended to read as follows:

7. That the Applicant is proposing to remove the existing garage from
the subject property by June 1, 1987.

The Commission agreed that Finding #8 should be amended to read as follows:

That the garage to be moved in is approximately 14' x 22' not to
exceed 24' x 24', subject to inspection for structural soundness
by the Building Official.

Motion by Commissioner Deemer and seconded by Commissioner Zimmerman to adopt
Findings of Fact #0149 (Please refer to Findings of Fact file) relating to
Berndt Development Co., Inc.'s request for a conditional use permit to move in
a residential garage for commercial use in the B-1 Business district.

Motion carried. Voting yes: Chairman Peterson, Commissioner LaDue,
Hendriksen, Howell, Deemer and Zimmerman. Voting no: None. Absent:
Commissioner Shumway.

The Commission suggested that the following conditions be included in the
conditional use permit for Berndt Development Co., Inc.

That the conditional use permit for moving in a residential garage
not to exceed 24' x 24' shall expire June 1, 1987 and that the
existing garage on the property shall be removed by June 1, 1987.

That the garage shall not be used for office space or customer
vehicle repairs. The garage may be used for vehicle clean up or
s t or age.

3. That only operable vehicles shall be stored on the property and that
no salvage activities shall be allowed on the subject property.

4. That the Applicant shall provide a certificate of lot survey when
applying for a building permit to move in the garage.

5. That the Applicant shall pave/blacktop the driveway to the subject
October 7, 1986

-6 -
