Mr. Springer stated that his business is seasonal; accessory structure limits <br />for one acre parcels are not adequate to store all his equipment inside. <br /> <br />Ms. Norris noted memo from City Attorney Goodrich dated August 5, 1986 which <br />states that including conditional use permit agreements in the agenda packet <br />implies approval of the request will be granted; recommend that if requests for <br />conditional use permits are to be approved, that the permit document include <br />any restrictions and conditions. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Zimmerman to adopt <br />Findings of Fact 0143 relating to a request by Mr. Scott Springer for a <br />conditional use permit to operate a snowplowing business from his home. <br />(Please refer to findings of fact file for Findings of Fact 0143). <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Zimmerman, <br />Deemer, LaDue and Howell. Voting No: None. Absent: Commissioners Shumway <br />and Hendriksen. <br /> <br />Mr. Springer stated that the number of vehilces on his property are 9; 5 for <br />snowplowing, dump truck and 3 personal vehicles. <br /> <br />Chairman Peterson stated that 9 vehicles might be too much for a one acre <br />residential lot. <br /> <br />Commissioner Deemer noted that it would be difficult to support a seasonal <br />business in a commercial area. <br /> <br />Kevin Bush - 17532 Unicorn - Stated that city snowplows don't get to <br />Countryside Estates until late afternoon the day after a snowfall. When Mr. <br />Springer leaves to plow his commercial contracts, he plows all the way to <br />Highway #10 from Countryside Estates; this enables area residents to make it to <br />work on snow days. <br /> <br />Commissioner Zimmerman noted that the city has not received any complaints from <br />Mr. Springer's neighbors. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend <br />approval of the request by Mr. Scott Springer for a conditional use permit to <br />operate a snowplowing business from his home at 8872 175th Lane NW with the <br />following conditions: <br /> <br />1. Ail vehicles on the property must remain properly licensed and <br /> insured. <br /> <br />2. Ail vehicles must have properly maintained muffler systems. <br /> <br />3. The applicant must provide adequate screening around the business <br /> vehicles. <br /> <br />4. There shall be no outside storage of fuel. <br /> <br />5.
