Chairman Peterson stated that the City Council is not bound by what Mr. <br />Struvy's attorneys say; Mr. Struvy would have to pursue the case in court on <br />his own. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Shumway, <br />Zimmerman, Howell, LaDue and Hendriksen. Voting No: None. <br /> <br />Birdie Rotramel - Requested that the Commission view the subject property <br />before making a decision. <br /> <br />Chairman Peterson replied that some of the Commissioners do make it a point to <br />view properties in question; some commissioners take the advice of the City <br />Engineer. <br /> <br />Commission would react favorably to a request for a variance to cul-de-sac <br />length if Mr. Johnson considers an alternative road alignment. <br /> <br />Citizen in audience claimed the roads in Autumn Heights are not adequate to <br />accomodate construction equipment traffic. <br /> <br />Chairman Peterson stated that if it can be proven that Mr. Johnson's <br />development process damaged the roads, he assumes the City will take action <br />against Mr. Johnson. Chairman Peterson also noted that there will be no <br />further public notices sent out regarding Mr. Johnson's plat; interested <br />parties should contact Ms. Norris at City Hall to find out when the case will <br />be addressed again. <br /> <br />Case ~6: Request For Conditional Use PErmit To Operate A Snow Plowin~ <br /> Ope~atign From Home; Case Of Scott Sprin~er: <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to table <br />action on Mr. Springer's request until Mr. Springer or his representative can <br />be present to answer questions and concerns. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Shumway, <br />Zimmerman, LaDue, Hendriksen and Howell. Voting No: None. <br /> <br />Request For Metes And Bounds Subdivision: Case Of Mr. <br /> <br />Mr. Jim Nachtwey was present stating he is in favor of the subdivision. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Howell to recommend <br />approval of Mr. Kunzman's request for a metes and bounds subdivision. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Shumway, Deemer, <br />Zimmerman, Howell, Hendriksen and LaDue.
