Case #12: <br /> <br />Adopt Resolutions Approving Plans and Specifications and <br />Ordering Advertisement for Bids and Authorizing Right-of-Way <br />Acquisition for Improvement Projects #89-17, g90-10 and 990-12 <br /> <br />Mr. Raatikka stated that per Council's previous action this evening, the proposed resolution to <br />approve plans and specifications and order bids for right-of-way acquisition should be amended to <br />delete Project #89-17 because that relates to the Bison Street Project. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to adopt Resolution <br />#90-07-223 Approving Plans and Specifications and Ordering Advertisement for Bids for <br />Improvement Project//90-10 (B augh Street N.W.) and//90-12 (Windsor Wood). <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, Pearson, Cich and <br />DeLuca. Voting No: None. <br /> <br />Case #13: <br /> <br />Adopt Resolutions Approving Plans and Specifications and Ordering <br />Advertisement for Bids for Improvement Project #89-4 <br /> <br />Mr. Raatikka stated that plans and specifications for the extension of 153rd Avenue N.W. between <br />Ramsey Boulevard N.W. and Nowthen Boulevard N.W. have been prepared. City Staff is <br />recommending approval of the plans and authorizing advertisement for bids. Mr. Raatikka noted <br />that the project will be done in two phases to coincide with right-of-way acquisition proceedings. <br />The right-of-way for the east end of the proposed project has been acquired and construction for <br />the west end will not be ordered until the City has all of the necessary easements in hand. <br /> <br />Mr. Goodrich noted that on August 2, 1990, the court will be reviewing the public purpose issue <br />relating to the extension of 153rd Avenue N.W. and associated condemnation procedures. <br />Typically the public purpose issue is not challenged and once the judge makes a decision on public <br />purpose, the City can have access. However, the land owners have the capability to appeal the <br />damages awarded at district court. <br /> <br />Douglas Fountain, 15255 Garnet Street N.W. - Mr. Fountain stated that an issue that may be <br />pertinent to the plans and specifications is the fact that there is a power pole in the northeast comer <br />of his lot that he feels the curbing of 153rd will be within one-half foot of. <br /> <br />Mr. Raatikka stated that he will review the road alignment and the staking of the road to be sure <br />that it is a sufficient distance from the power pole. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember DeLuca to adopt Resolution <br />#90-07-224 Approving Plans and Specifications and Ordering Advertisement for Bids for <br />Improvement Project #89-4. <br /> <br />Further Discussion: Councilmember DeLuca stated that he appreciates City Staff's efforts to <br />maintain control of the property before awarding a contract for the project. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers Pearson, DeLuca and Cich. <br />Voting No: None. Abstained: CouncilmemberPeterson. <br /> <br />Case #14: Animal Control Contract <br /> <br />Police Chief Michael Auspos stated that the City's contract with the County Humane Society for <br />Animal Control Services expired in May of 1990. However, the Society has continued their <br />service to Ramsey until their attorney could draft a new contract.
