Mr. Goodrich stated that he has been reviewing the events under which the northern portion of <br />Bison Street N.W. was initiated for improvements. In that review he has found that three of the <br />seven property owners affected submitted a petition for improvements to the northern portion of <br />Bison Street N.W. in accordance with the City Charter. Also in accordance with the City Charter, <br />one of those persons, Mr. Brett Scott, who signed the initiating petition appeared at the public <br />hearing on August 29, 1989 and officially withdrew his name from the initiating petition. Mr. <br />Goodrich stated that this action creates a situation of two out of seven of the affected property <br />owners being in favor of the initiating petition and that does not meet the 35% requirement called <br />for in the City Charter. Mr. Goodrich stated that the only other way a project can be initiated is by <br />a four-fifths vote of Council and he would like to do some additional research to make sure the <br />City is complying with the conditions of the charter and addressing Mr. Scott's concerns. <br />Councilmember DeLuca recalled that the only reason the residents on the southern portion of <br />Bisons Street N.W. agreed to the project was because the northern portion of Bisons Street N.W. <br />was going to be improved. Mr. Goodrich recommended that City Council table action on the <br />Bison Street N.W. project and request a more thorough report from City Staff. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Pearson to table both of the <br />Bison Street N.W. Improvement Projects until August 14, 1990. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers Cich, Pearson, DeLuca and <br />Peterson. Voting No: None. <br /> <br />After some discussion regarding the conflicting reports associated with the two Bison Street N.W. <br />Improvement Projects, Mr. Goodrich recommended that the City Council consider ceasing any <br />further research on the two projects and go back to calling a public hearing regarding <br />improvements to Bison Street N.W. as one project. Councilmembers Cich and Pearson withdrew <br />their motion to table action on both of the Bison Street N.W. Projects until August 14, 1990. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to schedule a public <br />heating for August 28, 1990 regarding improvements to both the north and south portion of Bison <br />Street N.W. and to direct the City Engineer to prepare a feasibility study regarding the same. <br /> <br />Motion carded. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich, and <br />Peterson. voting No: None. <br /> <br />Case #4: Request to Rezone the Proposed Plat of Chestnut Pond <br /> from I-1 Industrial to R-1 Urban Residential; Case of Mr. <br /> Peterson, Good Value Homes, Inc. <br /> <br />Addition <br />John <br /> <br />Mr. Hartley recalled that City Council's approval of the preliminary plat of Cedar Hills was <br />contingent upon the developer providing an additional outlet from Cedar Hills to either Sunfish <br />Lake Boulevard N.W.or Industry Avenue N.W. in addition to 144th Lane N.W. through Hunter's <br />Hill Addition. Mr. John Peterson of Good Value Homes has acquired additional property south of <br />Cedar Hills to be developed as Chestnut Pond Addition to provide for that additional access to <br />County Road #116. The subject property is currently zoned I-1 Industrial and would require a <br />rezoning to R- 1 Urban Residential in order to develop it with residential lots. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to adopt Findings <br />of Fact #0274 relating to Mr. John Peterson's request to rezone the proposed plat of Chestnut <br />Pond Addition from I-1 Industrial to R-1 Urban Residential. <br /> <br />Motion carded.
