Voting No: None. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Adopt Ordinance Re-zoning the Proposed Plat of Chestnut Pond <br />Addition from I-I Industrial to R-1 Urban Residential; Case of John <br />Peterson, Good Value Homes Inc. <br /> <br />Sylvia Frolik recalled that on July 24, 1990, the City Council adopted findings of fact and <br />introduced and ordinance to rezone Chestnut Pond Addition to R-1 Urban Residential. Ms. Frolik <br />noted that the ordinance is eligible for adoption at this time. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to adopt Ordinance <br />4/90-16 to rezone Chestnut Pond Addition from I-I Industrial to R-1 Urban Residential. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Peterson, Cich and <br />Pearson. Voting No: None. <br /> <br />Case #2: <br /> <br />Request for Preliminary Plat Approval of Chestnut Pond Addition; <br />Case of Good Value Homes, Inc. <br /> <br />Mr. John Peterson of Good Value Homes, Inc. was present requesting prelimina_D, plat approval <br />of Chestnut Pond Addition which consists of 18 lots and one outlot located just north of Industry <br />Avenue N.W. and south of the proposed Cedar Hills Addition. Mr. Peterson noted that the City <br />Staff is recommending park dedication being required on all 18 lots and that the Planning and <br />Zoning Commission is recommended park dedication being required on the 17 new lots and <br />waiving park dedication on the original homestead lot in lieu of the outlot being dedicated for <br />drainage. Mr. Peterson requested an explanation of the City's current park dedication ordinance. <br /> <br />Mr. Otto replied that on minor subdivisions of three of less lots, park dedication is due on the new <br />lots being created. On full subdivisions, which is what applies to Chestnut Pond Addition, park <br />dedication is due on the gross area or the total number of units being subdivided, whichever is <br />greater. <br /> <br />Sylvia Frolik stated that the City has the authority to require park dedication and drainage <br />easements on plats; these are two separate issues and the City should not set a precedent of <br />accepting drainage easements in lieu of park dedication. <br /> <br />.) <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember DeLuca to approve the <br />preliminary plat for Chestnut Pond Addition as per the City Engineer's letter dated July 31, 1990 <br />with the exception of soil borings and requiring dedication of Outlot A for drainage and utilities and <br /> <br />CITY COUNCIL/AUGUST 14, 1990 <br /> Page 8 of 20 <br /> <br /> <br />
