The provisions of this subdivision do not <br />apply to any person who rents or leases a snowmobile if such <br />person keeps a record of the name and address of the person or <br />persons renting or leasing such snowmobile, the registration <br />number thereof, the departure date and time, and expected time <br />of return thereof. Such record shall be preserved for at least <br />six months and shall be prima facie evidence that the person <br />named therein was the operator thereof at the time it was oper- <br />ated contrary to Minnesota Statutes, Sections 84.81 to 84.88, <br />100.26, Subdivision 1, or 100.29, Subdivisions 28' or 29. The <br />provisions of this subdivision do not prohibit or limit the prose- <br />cution of a snowmobile operator for violating any of the sections <br />referred to in this subdivision. <br />Laws 1967, c. 876, § 10. Motor' Vt,hicles .~§ 58~q t,t seq., <br /> ri.q{; et seq. <br /> <br />84.89 Confiscation of snowmobile used in burglary <br /> A law enforcement officer shall seize any snowmobile, as de- <br />fined in Minnesota Statutes, Section 84.81, used for the purpose <br />of gaining access to property for the purpose of committing the <br />crime of burglary, as defined in Minnesota Statutes, Section <br />609.58. Any snowmobile seized pursuant to this section shall be <br />held, subject to the order of the district court of the county in <br />which the burglary was committed, and shall be confiscated aft- <br />er conviction of the person from whom the snowmobile was <br />seized and disposed of in accordance with the procedure pro- <br />vided for equipment used in committing game and fish violations <br />by Minnesota Statutes, Section 97.50, Subdivision 6, except that <br />the balance of the proceeds from the sale of a confiscated snow- <br />mobile which are paid into the state treasury shall be credited to <br />the general fund. <br /> <br />Added by Laws 1969, c. 176, § 1. elf.
