space. The proposed building will be 1,408 square feet. Coupled with the existing garage of 704 <br />square feet, the applicant would have 2,112 square feet in accessory building space. This results <br />in an overage of 448 square feet. She stated the applicant would like to exceed the size <br />restriction in order to construct a detached accessory building that would accommodate the <br />storage of private use vehicles and equipment. <br /> <br />Associate Planner Geisler indicated the proposed detached accessory building will be located in <br />the rear yard. The proposed accessory building location will meet and/or exceed all setbacks <br />established in the R~I Rural Development District, and the applicant has legally obtained an <br />easement from the adjoining property owner to utilize their driveway for access to this proposed <br />structure. She indicated the concrete slab for this proposed structure has already been poured. <br />She stated this work occurred prior to the approval of the Conditional Use Permit and the <br />building permit, and without a required inspection. All work has since been halted until a <br />determination has been made regarding the request for a Conditional Use Permit for an oversized <br />accessory structure. She stated the contractor has been advised not to backfill around the slab so <br />that if the Conditional Use Permit and building permit are approved, the Building Inspectors will <br />be able to inspect the floating slab. <br /> <br />Public Input <br />Chairperson Nixt asked what kind of hardship it would cause if the applicant were asked to <br />excavate so a proper inspection could be completed. <br /> <br />Mr. Hennek indicated backfilling has not occurred. He stated additional excavating was done for <br />the sprinkler system but the slab has not been backfilled. <br /> <br />Chairperson Nixt stated the Building Inspectors will need to make a full inspection, and <br />additional excavating may be necessary. <br /> <br />Mr. Hennek stated that was not a problem. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to close the public hearing at <br />8:26 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Shepherd, Van Scoy <br />and Watson. Voting No: Commissioner Brauer. Absent: None. <br /> <br />Board Input <br /> <br />Commissioner Johnson asked what Staff is recommending. <br /> <br />Assistant Community Development Director Trudgeon stated they have certainly approved these <br />in the past. He indicated Staff is dismayed the slab was poured in advance, but it is his <br />understanding that it was a mistake.
