Motion ca,vied. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and Peterson. Voting No: None. Mr. Otto stated that the next issue deals with connection to the sewer system. It is proposed that Ramsey amend it's subdivision ordinance to add the definition of 'sewer availability' as being property adjacent to the right-of-way for sewer trunks or laterals. Currently, this wot.;d not present problems w itiJ respect to the C:.:v's standing policy of not imposing sewer and water utilities on existing development. There would be a conflict with the City's current p(,!icy if trunks are extend:::t along 142nd Avenue in Ramsey Terrace to serve future developments. Mr. I-]m'tley noted that if the City can plan it's improvements in a way that will avoid placement of trunks through existing development, the City can meet Metro Council's request and Ramsey's current policy. Motion by Councilmember Peterson and seconded by Councilmember DeLuca to adopt Resolution #89-06-130 regulating connection to sanitary sewer, amended as follows: Add: 'That it is the City's intent to negotiate with meu'opolitan Council the proper number o~ REC's based on its flows in 1991 in the event that the Anoka Waste Water Treatment Plant phase out is not complete. The City at that time may request the lifitng of the restriction of 500 REC's.' 'Whereas, it is the intent of the City Council to modi~' it's policy to comply with Metro Council development framework provided that Metro Council approves the City's current request to expand the MUSA area.' Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and Peterson. Voting No: None. Council recessed at 9:10 p.m. Mayor Reimann called the Council meeting back :o order at 9:22 p.m. Case #2: Park Dedication Ordinance: Mr. Otto recalled that at the joint meeting regarding the draft park dedication ordinance, it was determined that certain policy issues remaining would be a decision of City Council. The first issue is whether the land dedication should be even further reduced from 7% to 5% if 4 in 40 zoning is implemented. City Council consensus was that land dedication should remain at 7% with no credit given upon future resubdivision because park dedication is based on density. Mr. Otto noted that P.U.D.'s are exempt fl',om the park dedication requirements as long as a minimum of 20% of the land is available for private open .space or recreational use.
