Council recessed at 9:06 p.m. <br /> <br />Mayor Reimann called the meeting back to order at 9:22 p.m. <br /> <br />Case #4: Request To Rezone Lots 2 And 3, Block 1, Bulow's Addition From B- <br /> I Business To R-1U Residential; Case Of Mr. Arthur Bulow: <br /> <br />Mr. Goodrich referred to Council's action, just prior to recess, to introduce an ordinance to <br />rezone certain lots in Bulow's Addition; noted that the ordinance to rezone the lots had been <br />introduced at a previous meeting; recommended adoption of the ordinance at this time. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt Ordinance <br />#89-2 rezoning Lots 2 and 3, Block 1, Bulow's Addition, from B-1 Business to R-1U <br />Residential. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and <br />Cich. Voting No: None. <br /> <br />Case #5: Discuss Park Dedication: <br /> <br />Mr. Hartley recalled that Mr. Gobernatz' recent minor subdivision has raised a question <br />regarding whether or not park dedication requirements should be placed on resubdivisions. <br />Interpretation of the ordinance allows for park dedication requirements on resubdivision. <br /> <br />Mr. Otlo stated that he has researched the issue with other communities and virtually all of <br />them require park dedication only on the new lot being created or constructed on. The ways in <br />which the remainder of the property is handled varies; Champlin addresses the issue when it <br />comes up for resubdivision; Andover does not allow further resubdivisions for 3 years unless <br />the developer submits a full plat; Ham Lake does not require park dedication on minor <br />subdivisions; Eagan operates on the philosophy that once park land dedication is paid, it is <br />satisified and not required on subsequent resubdivision. Mr. Otto noted that Eagan would have <br />handled a case like Mr. Gobernatz' in one of two ways: a) require park land dedication on the <br />newly created lot, designate the balance of property as outlot and require park dedication on the <br />outlot when it is platted; b) Prepay park dedication for the entire parcel based on ultimate <br />assumed density and if that density is exceeded, the developer is responsible for the incremental <br />difference. Eden Prairie zones all property outside the urban area as rural; parcels develop via <br />a site plan and request for rezoning; no building permit is issued until the parcel is zoned <br />appropriately; park land dedication fee is acquired at the time of building permit issuance. <br /> <br />Mr. Goodrich noted that Coon Rapids requires park land dedication on the new lot being created <br />and defers on the balance of the property because the density of development on the balance of <br />the property is not known. <br /> <br />Mr. Hartley noted that under the existing ordinance, Ramsey could enter into a development <br />agreement with Mr. Gobernatz whereby a park dedication fee would be received by the City and <br /> <br />City Council/January 24, 1989 <br /> <br /> <br />
