Motion by Councilmember DeLuca and seconded by Councilmember Pearson directing City Staff <br />to approach the City of Mound regarding the purchase of their voting equipment. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Peterson and <br />Cich. Voting No: None. <br /> <br />Case #11: 153rd Avenue N,W. Railroad Crossing Agreement: <br /> <br />Mr. Raatikka stated that the City has received agreements from Burlington Northern for the <br />railroad crossings at I53rd Avenue Northwest and the Puma Street crossing. Mn/DOT has <br />approved State Aid Funds for the 153rd Avenue crossing. Mr. Raatikka recommended City <br />Council approval of the agreements. <br /> <br />Mr. Hartley noted that Ramsey would have to acquire additional liability insurance for the <br />crossing at Puma because it is private and not covered under the City's public liability <br />insurance. Mr. Hadley stated that he will research the cost of insurance and options before the <br />City. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Reimann to authorize the Mayor and <br />City Administrator to enter into the Private Roadway and Crossing Agreement with Burlington <br />Northern Railroad and submit the required payment, subjecl to the approval of the Cily <br />Attorney. <br /> <br />Further Discussion: Councilmember DeLuca hesitated to enter into an agreement for a private <br />crossing prior to knowing liability insurance costs. Mr. Hartley stated that the issue of <br />whether or not to maintain the private crossing based on insurance costs is present regardless <br />if the City enters into an agreement for the crossing or not; the only thing the private crossing <br />agreement does is permit the City to move forward with the construction of the crossing at <br />153rd. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Peterson, DeLuca and Cich. <br />Voting No: None. Abstain: Councilmember Pearson. <br /> <br />Mr. Hartley directed Mr. Raatikka to research the validity of State tax costs itemized on the <br />Construction and Maintenance Agreement for the 153rd Avenue crossing. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to authorize the <br />Mayor and City Administrator to enter into the Construction and Maintenance Agreement '[or 1he <br />153rd Avenue N.W. crossing with Burlington Northern Railroad and submit the required <br />payments subject to the approval by the City Attorney and Mn/DOT. <br /> <br />Fudher Discussion: Councilmember DeLuca inquired if the MSA funding has been approved for <br />the 153rd Avenue crossing.
