such alcoholic beverage, nor shall any person purchase, attempt to purchase, consume, or have another person purchase for on that person's behalf any alcoholic beverage. 3. No person under twenty-one (21) years of age shall receive delivery of an alcoholic beverage. 4. No person shall induce a person under the age of twenty-one (21) years 1o purchase or procure or obtain an alcoholic beverage. 5. Any person who may appear to the licensee, the license~'s employees or agents, to be ~,~der the age cf twenty-one (21) shall, upon d~mand of the licensee, an employee or agent, produce and permit to be examined an identification certificate issued by any Administrator of District Court in the State of Minnesota pursuant to Section 626.311 through 626.319, Minnesota Statutes. 6. In every prosecution for a violation of the provisions of this ordinance relating to the sale or furnishing of alcoholic beverage to persons under the age of twenty-one (21) years, and in every proceeding before the City Council with respect thereto, the fact that the minor involved has obtained and presented to the licensee, an employee or agent, ~ verified identification card issued by the Clerk of District Court in the State of Minnesota, from which it appears that said person was twenty-one (21) years of age and was regularly issued such identification card, shall be prima facie evidence that the licensee, the agent or employee is not guilty of a violation of such a provision and shall be conclusive evidence that a violation, if one has occurred, was not willful or intentional. 7. Proof of age for purchasing and consuming alcoholic beverages may be established only by a valid state driver's license or state identification card; or in the case of a forign national by a valid pasport. OTHER RESTRICTIONS ON PURCHASE OR CONSUMPTION 1. No person shall give, sell, procure or purchase alcoholic beverage for any person to whom the sale of alcoholic beverage is forbidden by law. No person shall mix or prepare alcoholic beverage for 'on sale' consumption in any public place not licensed in accordance with this code and the laws of the State of Minnesota. REVOCATION 1. The City Council may suspend or revoke an 'on sale" license for the violation of any provision or condition of this chapter or of any state law or federal law regulating alcoholic beverage and shall revoke such license for ~ny wil!fuI violas, ion which, under the laws of the state, is grounds for m:ndatory revocation, and shall revoke for failure to keep the insurance required by this chapter in full force and effect. 2. If the premises are not ready for occupancy within one year after the initial license is issued, the license shall be revoked and will not be reissued. The licensee may make an application for a new license, but will be given no special consideration as opposed to any other applicants. REVOCATION PROCEDURE Except in the case of a suspension pending a hearing on revocation, revocation or suspension by the Council shall be preceded by written notice to the licensee and a public hearing. The notice shall give at least 10 days notice of the time and place of the hearing and shall state the general nature of the charges against the licensee. The Council may, without any notice, suspend any license pending a hearing or revocation for a .period not exceeding 30 days. The notice may be served upon the licensee personally or by leaving the same at the licensed premises with the person in charge thereof. No suspension shall exceed 60 days. LICENSE YEAR A "on sale" license expires June 30 next following its effective date.
