such alcoholic beverage, nor shall any <br /> person purchase, attempt to purchase, <br /> consume, or have another person purchase <br /> for on that person's behalf any alcoholic <br /> beverage. <br />3. No person under twenty-one (21) years of <br /> age shall receive delivery of an alcoholic <br /> beverage. <br />4. No person shall induce a person under the age <br /> of twenty-one (21) years 1o purchase or <br /> procure or obtain an alcoholic beverage. <br />5. Any person who may appear to the licensee, <br /> the license~'s employees or agents, to be <br /> ~,~der the age cf twenty-one (21) shall, upon <br /> d~mand of the licensee, an employee or <br /> agent, produce and permit to be examined an <br /> identification certificate issued by any <br /> Administrator of District Court in the State <br /> of Minnesota pursuant to Section 626.311 <br /> through 626.319, Minnesota Statutes. <br />6. In every prosecution for a violation of the <br /> provisions of this ordinance relating to the <br /> sale or furnishing of alcoholic beverage to <br /> persons under the age of twenty-one (21) <br /> years, and in every proceeding before the <br /> City Council with respect thereto, the fact <br /> that the minor involved has obtained and <br /> presented to the licensee, an employee or <br /> agent, ~ verified identification card issued <br /> by the Clerk of District Court in the State of <br /> Minnesota, from which it appears that said <br /> person was twenty-one (21) years of age <br /> and was regularly issued such identification <br /> card, shall be prima facie evidence that the <br /> licensee, the agent or employee is not guilty <br /> of a violation of such a provision and shall <br /> be conclusive evidence that a violation, if <br /> one has occurred, was not willful or <br /> intentional. <br />7. Proof of age for purchasing and consuming <br /> alcoholic beverages may be established only <br /> by a valid state driver's license or state <br /> identification card; or in the case of a forign <br /> national by a valid pasport. <br /> <br />OTHER RESTRICTIONS ON PURCHASE OR <br />CONSUMPTION <br />1. No person shall give, sell, procure or <br /> purchase alcoholic beverage for any person <br /> to whom the sale of alcoholic beverage is <br /> <br />forbidden by law. <br />No person shall mix or prepare alcoholic <br />beverage for 'on sale' consumption in any <br />public place not licensed in accordance with <br />this code and the laws of the State of <br />Minnesota. <br /> <br />REVOCATION <br />1. The City Council may suspend or revoke an <br /> 'on sale" license for the violation of any <br /> provision or condition of this chapter or of <br /> any state law or federal law regulating <br /> alcoholic beverage and shall revoke such <br /> license for ~ny wil!fuI violas, ion which, <br /> under the laws of the state, is grounds for <br /> m:ndatory revocation, and shall revoke for <br /> failure to keep the insurance required by <br /> this chapter in full force and effect. <br />2. If the premises are not ready for occupancy <br /> within one year after the initial license is <br /> issued, the license shall be revoked and will <br /> not be reissued. The licensee may make an <br /> application for a new license, but will be <br /> given no special consideration as opposed to <br /> any other applicants. <br /> <br />REVOCATION PROCEDURE <br />Except in the case of a suspension pending a <br />hearing on revocation, revocation or suspension <br />by the Council shall be preceded by written <br />notice to the licensee and a public hearing. The <br />notice shall give at least 10 days notice of the <br />time and place of the hearing and shall state the <br />general nature of the charges against the <br />licensee. The Council may, without any notice, <br />suspend any license pending a hearing or <br />revocation for a .period not exceeding 30 days. <br />The notice may be served upon the licensee <br />personally or by leaving the same at the licensed <br />premises with the person in charge thereof. No <br />suspension shall exceed 60 days. <br /> <br />LICENSE YEAR <br />A "on sale" license expires June 30 next <br />following its effective date.
