CASE # 3 <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT TO MAINTAIN <br /> ONE ADDITIONAL DELIVERY TRUCK FOR A HOME <br /> FIREWOOD SALES BUSINESS; CASE OF ARNOLD KLAR <br /> By: Planning Assistant Syh'ia Frolik <br /> <br />Background: <br /> <br />As you recall, on April 25 City Council reviewed Mr. KlaFs request for a conditional use permit <br />amendment to have one additional delivery truck on his property at 16020 Potassium Street N.W. <br />relating to the firewood business. In addition, Mr. Klm' requested that the accessory equipment for <br />the firewood business, that has been in use on the property since the issuance of the conditional <br />use permit, also be listed on the amended permit. In response to Mr. Klar's request, Cour!zil <br />expressed concern that the existing conditional use permit is in violation by the firewood being <br />stacked in the side yard rather than the rem. yard. Council also expressed concern with the size of <br />the operation and fire safety features. Council then amended and adopted the findings of fact and <br />tabled further action, directing City Staff to meet with lx~. Klar to draft a conditional use permit <br />amendment that would ad&ess operation size and frre safety features in addition to allowing for an <br />additional delivery truck. <br /> <br />Observations: <br /> <br />Fire Chief Bruce Hoeke and Planning Assistant Frolik inspected the Klar property on Monday, <br />May 1 and observed the following equipment: <br /> <br />one wood trailer <br />one cat trailer <br />one low-boy mailer <br />one backhoe with cat crawler <br />one bobcat <br />two 1-ton trucks <br />two 2-ton tracks <br />one pickup (Mr. Klm. claims this is a personal vehicle) <br /> <br />Although the U shape woodpile formation serves as the best alternative for keeping the equipment <br />and operation from public view, in it's present quantity (100+ cords) it would be a major task for <br />the fire department to deal with in the event of f'zre. The Fire Chief recommends that no woodpile <br />exceed 50 cords. Staff recommends that the height of the woodpiles be restricted to 8 feet. <br /> <br />In keeping with Council's direction to review fire safety features and negotiate business size limits, <br />the following options are presented: <br /> <br />.Option #1 For A 70 Cord Operation: <br /> <br />Retain the U shape formation in the no,w.h side yard and reduce the quani .ty to 50 cords. <br />One colunm of firewood parallel to rem. property line containing 20 cords of wood. <br />Store equipment on the interior of the U. <br />If selected, Fire Chief recommends reduction in inventory to be complete by March, 1990. <br /> <br /> <br />
