Case <br /> <br />PARK DEDICATION ORDINANCE <br /> <br />BY: MERLAI~D oTTO <br /> <br />Background: <br /> <br />The City Council held joint workshop meetings with the Planning and <br />Zoning and Parks Commissions on February 22, 1989 and on May 11, <br />1989. The purpose of the meetings was to develop a new parks <br />dedication ordinance which could be introduced. At the May llth <br />meeting, the Commissions expressed that the City Council should <br />make the remaining decisions on the draft ordinance. <br /> <br />We have again revised the draft ordinance on the basis of the <br />comments that were expressed at the May llth meeting. Deletions <br />are indicated by strikeout and additions are underlined. <br /> <br />Observations: <br /> <br />It appears that the key items of discussion remaining prior to <br />introduction of an ordinance are: <br /> <br />170.062 <br /> <br />170. 064 <br /> <br />170.066 <br /> <br />If 4 in 40 zoning is adooted, should those <br />landowners be reon/ired to ded~cat~ 7~of <br /> land <br /> or <br />should it be further reduced to 5%~~ <br />Note only - PUP's are exempt under current~ <br />ordinances from park dedication requirements as lon~ <br />as a inim of 20o of !and is available <br />open space or recreational use. ~ If desired, Councl-i-l- <br />should address this in City Coae Section 170.016K..~ <br /> <br />Cash payment currently reflects a reduction to 5% <br />for rural residential development on lots greater <br />than 5 acres in size. This needs to be made <br />consistent with decision on Section 170.062. <br /> <br />The amount of the cash contribution per dwelling <br />unit. Again, this should be consistent with <br />decision on Section 170.062. The consensus appeared <br />to be a flat fee per dwelling unit for all types of <br />housing. The current ordinance provides for $500.00 <br />per unit and this appears to have acceptance. <br /> <br />Cash payment would no~ma!ly be based on the dwelling <br />unit basis (assuming $500.00/d.u. except when the <br />value of land exceeded $2000.00 per acre at rural <br />densities of 2.5A/unit and when the value of land <br />e>:ceeded $!7,000 per acre at urban densities of 3.4 <br />units acre. Only then would 10% of the fair market <br />value need to be considered. <br /> <br /> <br />
