GRADING AND EXCAVATING <br /> CONDITIONAL USE PERK. IT AGREEMENT <br /> RAM. SEY CENTER PARTNERSHIP <br />By: Pete Raatikka, City Engineer <br />and Bill Goodrich, City Attorney <br /> <br />CASE <br /> <br />Background: <br /> <br />On December 8, 1987, City Council adopted Ordinance No. 87-9 which <br />added Section 170.017M of the City Code entitled Grading, Mining <br />and Filling Permits. That ordinance required all existing grading <br />mining and filling operations to be in compliance by July 11, 1988. <br /> <br />At the time of the adoption of the Ordinance, the Ramsey Center <br />Partnership had a grading and excavating permit agreement in <br />effect. The site of the permit is located east of State Trunk <br />Highway 47 and north of 142nd Avenue N.W. The Ramsey Center <br />Partnership did not use or request a renewal of the original <br />conditional use pe~--mit to continue the grading and mining operation <br />until this spring. Rather than go through the formal process of <br />applying for a new conditional use permit, we met with the Ramsey <br />Center Partnership and revised the grading and excavating <br />conditional use permit agreement to comply with the current <br />ordinance. The Ramsey Center Partnership has also provided the <br />required additional information, insurance certificates and <br />performance bond. Enclosed is a copy of the revised grading and <br />excavating conditional use permit agreement. <br /> <br />Recommendation: <br /> <br />Staff recommends approval of the revised grading and excavating <br />conditional use permit agreement. <br /> <br />Council Action: <br />Motion to approve the revised grading and excavating conditional <br />use permit agreement for the Ramsey Center Partnership and <br />authorize the Mayor and City Administrator to execute the <br />agreement. <br /> <br />Review Checklist: <br /> <br />City Administrator X <br />City Attorney ...X <br />City Engineer X <br />Community Development Dir. <br /> <br />Chief of Police <br />Finance Officer <br />Public Works Supt. <br />Other <br /> <br /> <br />
