GRADING AND EXCAVATING CONDITIONAL USE PERi, IT AGREEME~ <br /> <br /> THIS GRADING AND EXCAVATING CONDITIONAL USE PER/(~IT is issued <br /> <br />this day of , 1989, by the CITY OF RAMSEY, <br /> <br />hereinafter referred to as "CITY" and RAMSEY CENTER PARTNERSHIP, <br />ART R3%UDIO, General Partner, 1404 South Broadway, Sauk Rapids, MN, <br />telephone no. <br /> <br />1-251-7689, hereinafter referred to as "PERMITTEE." <br /> <br /> WHEREAS, the CITY and PEP~ITTEE in 1985 entered into a Grading <br />and Excavating Permit Agreement for the property legally described <br />as follows: <br /> <br /> Government Lots 3 and 4, Section 25, Township 32, Range <br /> 25, and that part of the east half of the Southwest <br /> Quarter of Section 25, Township 32, Range 25 lying East <br /> of State Trunk Highway 47, Anoka County, State of <br /> Minnesota; except that plat known as River's Bend and <br /> that portion of parcel 25-32-25-31-0002 lying east of <br /> State Trunk Highway 47. <br /> <br /> ("the Site"). <br /> <br /> WHEREAS, the grading and excavating on the Site and pursuant <br />to the 1985 Agreement has yet to be completed; and <br /> <br /> WHEREAS, in 1987, the CITY adopted a new ordinance, Ordinance <br />87-9 which Ordinance required that all existing mining and grading <br />operations comply with its provisions; and <br /> <br /> WHEREAS, PERMITTEE desires to comply with said Ordinance 87- <br />9 and continue its operations at the Site. <br /> <br /> NOW THEREFORE, the CITY hereby reinstates the PERMITTEE's 1985 <br />permit and certifies it to be in conformance with Ordinance 87-9, <br />conditioned on the following terms, and conditions: <br /> <br /> <br />
