1. Purpose of Permit. The purpose of the permit is mining, <br /> and grading in order to prepare the Site for future development. <br /> <br /> 2. Operator. The actual operator performing the mining and <br />excavation on the Site will be R & S Asphalt, Inc., 700 Industry <br />Avenue NW, P.O. Box 249, Anoka, MN ("Operator"). The contact <br />person for H & S Asphalt shall be Norm Holm whose telephone no. is <br />427-4900. <br /> <br /> 3. Responsibility for Operator. PERMITTEE accepts all <br />responsibility for Operator and warrants performance of Operator <br />pursuant to this Agreement. <br /> <br /> 4. Vegetation. There is no existing vegetation on the Site. <br /> <br /> 5. Erosion Control. Berms will be constructed for erosion <br />control on the Site. <br /> <br /> 6. Storm Water Drainage System. The CITY has constructed <br />a storm water drainage system serving the Site. <br /> <br /> 7. Dust Control. Operator will water access roads to <br />minimize dust and will discontinue work at any time wind gusts <br />exceed 30 m.p.h, at the Site. In addition, if in the CITY <br />Engineer's opinion the dust created by the operation is excessive, <br />the operation shall cease until conditions improve. <br /> <br /> 8. Water ~ells and Dewatering. There are no water wells on <br />the Site. PER/~ITTEE does not anticipate dewatering at this time, <br />and if necessary, PERMITTEE agrees to obtain appropriate DNR <br />permits for dewatering. <br /> <br /> 9. Safety Fencing. Safety fencing will not be required <br />because 2:1 slopes will be maintained at all times. <br /> <br />2 <br /> <br /> <br />
