Case # ZT/
APPLICATION OF F & R ENTERPRISES FOR AN OPEN BURNING PERMIT
By: William Goodrich, City Attorney

Background:

As you will recall, F & R applied for an open burning permit in June, 1989. This was for the
property located generally north of Highway #10, west of Puma Street, south of 153rd Avenue,
and east of County Road #83. On July 25, 1989, the Council denied that application. For your
information, enclosed is a copy of the Council's findings adopted at that time. F & R is again
applying for a burning permit at the same site to burn the same material described in the July
25, 1989 findings. Also enclosed is a copy of F & R's most recent request. The request is
basically the same as the previous burning request, except that no burning would be permitted
unless there is a snow cover of at least six inches on the site. The City's Fire Chief has reviewed
F & R's current application and is in general concurrence, with some modifications. Staff
proposes that a burning permit be issued to F & R with those conditions outlined in the enclosed
proposed resolution.

Enclosures:
A)

C)

F & R Application
Findings of Fact Adopted 7/25/89
Proposed Resolution

Recommendation:

Staff recommends approval of the permit conditioned on those items shown on the proposed
resolution.

Council Action:

Motion to:
Adopt Resolution #89-10- which is a resolution granting an open burning permit
to F & R Enterprises, a Minnesota Partnership.

Review Checklist:

City Administrator X
City Attorney X
City Engineer X
Community Development Director X

Chief of Police
Finance Officer
Public Works Supervisor
Fire Chief

X
