Councilmember <br />resolution and moved for its adoption: <br /> <br />introduced the following <br /> <br />RESOLUTION #89-10-__ <br /> <br /> WHEREAS F & R Enterprises, a Minnesota Partnership has applied <br />to the city for an Minnesota Pollution Control Agency ("MPCA") Open <br />Burning Permit; and <br /> <br /> WHEREAS, the open burning permit request is for permission to <br />conduct open burning on that property legally described as follows: <br /> <br />The Northeast Quarter of the Northwest Quarter of Section <br />29, Township 32, except the Right-of-Way line of the <br />Burlington Northern Railway, County of Anoka, State of <br />Minnesota; <br /> <br />(the "Site"); and <br /> <br /> WHEREAS, the purpose of the burning is to burn a substantial <br />number of fallen pine trees on the site which are damaged and dead; <br />and <br /> <br /> WHEREAS, the damage to the trees occurred as a result of a <br />fire in April, 1988, allegedly caused by a passing train; and <br /> <br /> WHEREAS, the city previously denied an open burning permit to <br />F & R in July, 1989, based on then extremely dry conditions at the <br />site including possible smoke nuisance and fire hazard to adjacent <br />properties; and <br /> <br /> WHEREAS, F & R now proposes to burn only in the winter months <br />when at least six (6) inches of snow cover is present on the site; <br />and <br /> <br /> WHEREAS, the City's Fire Chief is of the opinion that the snow <br />cover provision will substantially decrease the fire hazard from <br />the burning site and surrounding properties; and <br /> <br /> WHEREAS, the City has <br />permits conditioned upon <br />regulations; and <br /> <br />the authority to issue open burning <br /> compliance with MPCA rules and <br /> <br /> WHEREAS, the City requires that the open burning be in <br />compliance with MPCA rules and regulations relating to air quality <br />and air emissions. <br /> <br /> NOW, THEREFORE, the City Council of the City of Ramsey grants <br />an open burning permit to F & R Enterprises, a Minnesota <br />Partnership, upon the following conditions: <br /> <br /> <br />
