PROPOSED FINDINGS OF FACT <br />REZONE PORTIONS OF PROPOSED FLEISCHER'S 2ND ADDITION <br />FROM R-3 URBAN AND B.1 BUSINESS TO R-1 URBAN RESIDENTIAL <br /> October 17, 1989 <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />4) <br /> <br />5) <br /> <br />6) <br /> <br />7) <br /> <br />8) <br /> <br />9) <br /> <br />That Doloras Fleischer, hereinafter referred to as "Applicant", has properly applied for a <br />rezoning of portions of the proposed FLEISCHER'S 2ND ADDITION from R-3 Urban <br />Residential and B-1 Business to R-1 Urban Residential. <br /> <br />That the Planning and Zoning Commission conducted a public hearing pursuant to Section <br />170.013C of the City Code on October 3, 1989 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />That the property, which is proposed to be named Fleischer's 2nd Addition, is legally <br />described as follows: <br /> <br />That pan of the Northwest Quaner of the Northwest Quarter and of the Southwest Quarter <br />of the Northwest Quarter lying northeasterly of County Road No. 5, Section 25, Township <br />32, Range 25 (except the two following described u-acts). (1) The east 220 feet of the <br />south 1386 feet of the west half of the Northwest Quarter of Section 25, Township 32, <br />Range 25, lying northerly of the center line of County Road No. 5 as the same is laid out <br />and traveled; (2) That pan of the Northeast Quarter of the Northeast Quaner of Section 25, <br />Township 32, Range 25, that is described as follows. Commencing at the intersection of <br />the Nowthen Road so called and the north line of said Section 26 and proceeding then in a <br />southeasterly direction along the center line of said Nowthen Road for a distance of 54 rods <br />proceeding then in a northeasterly direction and at right angles to said Nowthen Road so <br />called for a distance of 16 rods proceeding then northwesterly in a straight line to the <br />common comer between Section 25 and 26, 23 and 24, said township and range <br />proceeding then west on the north line of said Section 26 to the point of commencment <br />(except that pan taken for Highway by County. <br /> <br />That the total subject area of the proposed FLEISCHER'S 2NrD ADDITION is <br />approximately 44 acres in size. <br /> <br />That approximately 10 acres of the subject property is currently zoned R-1 Urban <br />Residential; approximately 24 acres of the subject property is currently zoned R-3 Urban <br />Residential; approximately 10 acres of the subject property is currently zoned B-1 <br />Business. <br /> <br />That the subject property is bounded on the north by R-1 Urban Residential and one parcel <br />of B-2 Business; on the east by R-3 Urban Residential and B-1 Business; on the south by <br />B-1 Business; and on the west, across Nowthen Blvd. N.W., by R-1 Urban Residential <br />and R-3 Urban Residential. <br /> <br />That the Applicant is proposing to develop the subject property with 87 single family lots to <br />be served by sanitary sewer and municipal water. <br /> <br />That the subject property is located in the MUSA area. <br /> <br />That the proposed rezoning that portion of the property currently zoned R-3 Urban <br />Residential would reduce the City's current inventory of multi-family zoning by about one- <br />fourth. <br /> <br /> <br />
