Requlr~ Period of Performance <br /> <br />The City Council requires the capability to begin preparation of the first <br />technical report by March 15, 1990. Each report shall be completed within <br />30 days following request of the consultant to begin the work by the City. It <br />is anticipated that the consultant contract will terminate July, 1991. <br /> <br />Maximum Compensation nnd Manner of Payment <br /> <br />Compensation will be negotiated for each consultant's portion of the <br />project with a "not to exceed" limit clearly defined prior to starting work. <br /> <br />Legislative Direction <br /> <br />During the last two legislative sessions, there has been an attempt to <br />abandon the landfill siting process. The Senate has overwhelmingly voted <br />to abandon the process. The House has overwhelmingly opposed <br />abandoning the process. In conference committee, the effort to abandon <br />has lost. Senator Dahl has again sponsored legislation to abandon the <br />process in this session, however, it is unlikely as things now stand that <br />this will be successful. Several items support this opinion: <br /> <br />MC has flipped its public position to again paint a "crisis of <br />landfill capacity". <br /> <br />Rep. Dee Long who authored the Solid Waste Act of 1980 and is <br />protective of the process has become a more powerful figure in <br />the House. <br /> <br />The process is farther along now so that the likely position will <br />be to complete the remainder of the process. <br /> <br />Nevertheless, significant legislative protection for local control and <br />conformance with state laws may be achieved. This is a key element for <br />this legislative session since new rules adopted by MPCA repealed the <br />former permitting requirements that required landfill sit~s to be in <br />conformance with all applicable federal and state laws and requirements <br />as well as local ordinances. <br /> <br />The question is - should staff proceed to lay ground work for passage of <br />legislation which would help reestablish local control and environmental <br />restrictions on landfill siting and operation? <br /> <br />Page 10 <br /> <br /> <br />
