Under this scenario, maintenance of the County 5 berm would go back to the individual lot <br />owners. Maintenance of the median and roundabout landscaping would be left to whoever <br />wanted to do so, if any, and the same is true of the Brookfield Lake pumping apparatus. <br />The bottom line here is that the original HOA documents and declaration were not properly <br />prepared. Neither the Bank nor the City had anything to do with those documents. The Bank <br />inherited the situation, and has contributed substantial time and money to try to fix what was <br />already broken.
