5.3 PACT may lease space from any government, public, or nonprofit, nonsectarian <br />private organization, as it deems necessary. <br />5.4 PACT Charter School shall assume full liability for its activities and shall indemnify <br />and hold harmless the Commissioner and Bethel UNIVERSITY, its officers, and <br />their agents and employees from any suits, claims, or liability arising under this <br />Contract under Minnesota State section 124D.10, subdivision 25 (1994), as amended, <br />and this paragraph is not intended to modify or otherwise affect that provision or any <br />other law. <br />6 PERFORMANCE INDICATORS AND EVALUATION. <br />6.1 PACT will document that students are demonstrating successful progress at meeting <br />or exceeding the standards for graduation as established by the State of Minnesota <br />and applicable to public schools in accordance to the Commissioner's guidelines <br />(section 1241J. I0 subd. 10). <br />6.2 PACT will identify annual goals with specific and measurable outcomes to achieve <br />through its educational programs in various academic and non-academic areas related <br />to PACT's stated purpose and mission. Some of these outcomes may be assessed <br />using a nationally norm referenced test using year to year comparisons. BE"111EL <br />UNIVERSITY will review annual goals established by PACT and approved by the <br />Board included within the Annual Report, <br />6.3 13E;I'l-I I, UNIVERSITY will implement a plan to evaluate PACT to determine the <br />effectiveness of PACT's program in attaining the pupil outcomes set out in Section <br />6.2. <br />6.4 In the event the PACT has not met the approved pupil outcomes, PACT shall advise <br />the Commissioner, BETH:EL UNIVERSITY and PACT staff, students and parents on <br />how it plans to achieve the prior year's goals and shall incorporate those plans into <br />the academic goals in the Annual Report, <br />7 ADMISSION POLICIES AND PROCEDURES. <br />7.1 PACT CHARTER SCHOOL is open to all students for kindergarten through twelfth <br />(12111) grade. <br />7.2 PACT will limit enrollment to available space and as interest in enrollment dictates. <br />7.3 PACT shall admit any eligible pupil who submits a timely application, unless the <br />number of applications exceeds the capacity of the program, class, or grade level. <br />Admission of pupils will not be determined on the basis of intellectual ability, <br />measures of achievement or aptitude, or athletic ability. <br />7.4 If the number of applications for any grade shall exceed the number of openings, <br />siblings of continuing students will receive first preference for admission as required <br />by the Act. For other openings, students shall be accepted by lot. To the extent the <br />number of applications exceed the number of openings PACT will use its approved <br />lottery procedures to fill openings. A summary of lotteries will be kept in the PACT <br />Business Office for review, upon request by BETHEL UNIVERSITY or the <br />Commissioner. <br />PACT Charter School/Bethel University Contract July 2009 <br />Page 4of9 <br />D-6 <br />D-10 <br />
