Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #90-03- <br /> <br />RESOLUTION SUPPORTING-~CITY STAFF DETERMINATION <br />AND IMPROVEMENTS TO PIN 36-32-25-21-0006 BY <br />PERMISSIBLE UNDER SECTION 170.015H OF THE CITY <br />CONFORMING USES) <br /> <br />THAT USE OF <br /> WCCO ARE <br /> CODE (NON- <br /> <br /> WHEREAS, PIN 36-32-25-21-0006 is located in the City of Ramsey, and is legally <br />described as follows: <br /> <br />The Northeast Quarter of the Northwest Quarter of Section 36, Township 32, Range 25, <br />Anoka Count3,, Minnesota, described as follows: <br /> <br />Commencing at the northeast comer of said Northwest Quarter; thence south along the east <br />line thereof 936.25 feet to the centerline of a town road; thence northwesterly to the right <br />deflection angle 96 degrees 41 minutes a distance of 604.08 feet; thence north parallel with <br />the east line of said Northwest Quarter a distance of 865.73 feet, more or less, to the north <br />line of said Northwest Quarter; thence east along the north line thereof a distance of 600.00 <br />feet, more or less, to the point of beginning. Subject to the fights of public over the south <br />33.00 feet thereof for road purposes. "Subject property". <br /> <br /> WHEREAS, the City of Ramsey considers the radio antenna on the property to be a non- <br />conforming use; and <br /> <br /> WHEREAS, Ramsey City Code Section 170.015H establishes criteria allowing for the <br />continuance of non-conforming uses; and <br /> <br /> WHEREAS, the City of Ramsey received a letter from Attorney Mark Hamel dated <br />November 27, 1989, a copy of which is on file with the City of Ramsey, indicating WCCO's <br />interest in purchasing the subject site for use as a stand-by radio transmission facility with certain <br />improvements; and <br /> <br /> WHEREAS, representatives of WCCO and City Staff met on January 16, 1990 to review <br />the proposed use of and improvements to the subject site; and <br /> <br /> WHEREAS, City Staff determined that the proposed use of and improvements to the <br />subject property are within the criteria allowing for the continuance of a non-conforming use <br />according to Ramsey City Code Section 170.015H. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the CiD, Council supports CiD, Staff determination and hereby authorizes the issuance <br />of a letter to WCCO in substantially the form attached hereto, indicating that the proposed <br />use of and improvements to the subject property as described in a letter to the City of <br />Ramsey Planning Assistant Sylvia Frolik from Attorney Mark Hamel dated November 27, <br />1989, are permissible under Ramsey City Code Section 170.015H (Non-Conforming <br />Uses). <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the 27th day of March, 1990. <br /> <br /> <br />
