ANOKA-CHAHPLIII JOINT FIRE DEPARTMENT '" CONTI~ACT-FOR FIR~- PROTECTION AND F24~F~RG~-NCY SERVIC~'-S ~ 1990 THIS AGREEMENT, made and entered into by and between the Anoka-Champlin Joint Powers Fire Board, the party of the first part, hereinafter referred to as the "Joint Fire Board" the governing body of a fire department jointly owned and operated by the City of Anoka, a Municipal Corporation, o~ the County of Anoka and State of Minnesota, and the City of Champlin, a Municipal Corporation, of the County of Hennepin and the State of Minnesota; and the CIT¥ oF ~sE¥ Fin the County of Anoka, State of Minnesota, party of the second part. WITNESSETH: That in consideration of the sum of sixty-one thousand four hundred £ift¥-si× and dollars per year, payable in advance by second party to said Joint Fire Board, said Joint Fire Board agrees to furnish fire protection, fire suppression, emergency rescue, extrication and those other services normally and customarily performed by a fire department to the property located in, or emergency incidents within the boundaries of said city of Ramse¥ for the compensation and on the conditions hereinafter set forth, and the said Joint Fire Board further agrees that when called to property or incidents within the boundaries of the ~}r7 of Ramsey its firefighters will make a reasonable effort to respond to fires or perform other'requested emergency services, PROVIDED HOWEVER: 1. That the road and weather conditions be such that the emerpency response can be made with reasonable safety to personnel and equipment, and the decision of the Anoka- Champlin Fire Chief or senior fire department officer in charge shall be final in such a ~atter. 2. That in the event ali fire department equipment and personnel are engaged in another emergency situation at the time a call comes in from said second party, the Anoka- Champlin Fire Department will call for mutual aid and any other help that might be available, because of the emergency or disasterous nature of the situation. However if all means of providing service are exhausted, and in the discretion of Joint Fire Board members and the Fire Chief or senior fire officer in charge, such equipment and members of said fire department are needed in Anoka or Champlin, the Joint Fire Board shall be held free and relieved from all liability to make said run or to respond to said call. 2. 'In the event the Anoka-Champlin Fire Depar'tment has responded to an emergency in the Cit7 of Ramse7 and another fire department emergency response is required within ~the Cities of Anoka or Champlin, the Anoka-Champlin Fire Department will not leave the city of Ramse7 emergency situation unattended. The Anoka-Champlin Fire Department will either remain to perform the necessary emergency service or will provide services from another municipality through mutual aid agreements. 4. If for any reason the Fire Chief or senior fi~e officer shall deci6e that no equipment or firefighters can be spared, the decision of the Fire Chief or senior fire officer shall be final. 5. That said Joint Fire Board shall not be liable in any way to the second party or to any other person, firm or corporation for failure'of the Fire Department of said Joint Fire Board to attend a fire or to extinguish a fire or for any damage to or loss of goods, or for any act, omission, or for any other reason. 6. That in addition to the above mentioned sum of sixty-one thousand'four hundred fifty-six and 24/)OO's dollars per year, said second party agrees to pay as compensation for services rQndered hereunder, the cost of each run by the Fire Department to said City when called by said second party or when made for the benefit of said second party or when made to a place within the boundaries of said second party, said sum to be paid when billed by
