I I ! I I I I I I I I I I I CONDITIONAL USE PERMIT WASTE MANAG~ OF MINNESOTA, INC. IOn November 15, i988, the City of Ramsey, Anoka County, Minnesota ("city") issued a conditional use perm. it ("CUP") to Waste Management of Minnesota, .Inc. ("WMMI"), for: I (a) Usin land currently zoned for industrial use for Vertical Expansion of the exlstlng landfill with a maximum of 635 acr= · feet of additional landfill capacity ("Vertical Expansion"); (b) Using land currently zoned as industrial and residential for construction of a tow rope, warming house and adjacent parking facilities and perimeter fence and operation of a ski hill and sledding recreational facility in connection with the above described improvements ("Ski Hill Facility"); and (c) Excavation, grading and transportation of soil materials for use as landfill cover material ("Borrow Activity"). Said activities shall be conducted on the property legally described on Exhibits A and B attached hereto and incorporated herein by this reference ("Subject Property"). This Pe_~mit is issued pursuant to Sections !70.013D and 170.0!M of the Ramsey City Code. This CUP is valid for the following periods so long as the conditions imposed herein ara complied with: ~'(a) Vertical Expansion - Three years from January 1, 1989, ~ith a maximum of four successive six month extensions as required to bring the Ve~ical Expansion to capacity which is a maximum of 635 acre-feet. W~IMI's stated intention with respect to receiving waste is to encourage the volume of solid waste entering the site in order to exhaust the pe_--mitted capacity as soon as practicable. Minim,un performance goals are set forth herein and shall be used to evaluate whether the CUP shall be extended. Perfo_~ance goals are: At the end of the 3 yJar period: First six month e~ension: Second six month e~ension: Third six month extension: Fourth six month e~ension: min. 60% of capacity min. 70% cf capacity min. 80% of capacity min. 90% of capacity !00% of capacity. In the event WPL~_~I is aohieving c= su_-passing the stated goals, a six month extension shall be granted. In the event Iv?L~-~i is not achieving the stated goals, it shall be sufficient grounds for revocation of this CUP consistent with the te~.s set fo_-~n herein.
