WMMI shall, following the conveyance of the road <br /> right-of-way and within sixty (60) days after the City's request <br /> to commence grading during the normal construction season, rough <br /> grade the road right-of-way in accordance with a plan prepared and <br /> approved by the City Engineer and on file with the City. Subcut <br /> below final proposed grade shall be made only for the purpose of <br /> soil correction and minor adjustment of subgrade. Obtaining any <br /> permits or other approvals which may be required to locate cr <br /> rough grade the road right-of-way shall be the sole responsibility <br /> of the City. <br /> <br />LANDFILL ACTIVITIES <br /> <br />15. Geographical Limits of Vertical Expansion. The Vertical Expansion <br /> shall be confined to the present geographical limits (or <br /> "footprint") of the existing landfill as legally described on <br /> Exhibit A attached hereto. <br /> <br />16. Grading Plan. All grading and excavating shall be limited to a <br /> grading and excavating plan approved by the MPCA and on <br /> file with the City. <br /> <br />17. Airspaqe Review. WI{MI shall submit a notice of proposed construc- <br /> tion to the Federal Aviation Administration ("FAA") and shall <br /> comply.with reasonable.applicable limitations, restrictions, <br /> obstruction lighting, or operational controls to assure that the <br /> landfill operations minimize hazards to air navigation. <br /> <br />18.. Sit~ Heiqht'Limitation. The maximum elevation of the Vertical <br /> Expansion shall no= exceed 1024 feet mean sea level (MSL) at <br /> completion of the disposition of waste in ~he Vertical Expansion. <br /> The Vertical Expansion shall be designed and constructed so that <br /> the final elevation of the Ve~ical Expansion following settling <br /> shall not exceed 1020 feet MSL. No appu~enances or structures <br /> shall be placed on the subject property which exceed an elevation <br /> of 1020' MSL. Final slopes for the Ve~ical Expansion will be a <br /> maximum of twenty-five percent (25%). <br /> <br />19. Site Security. This site shall be properly safeguarded to prevent <br /> ~he general public from depositing garbage or other refuse in <br /> site during hours that the landfill is not open to receive solid <br /> waste. <br /> <br />20. Workinc Conditions. The fill area shall be continually policed <br /> and shall be keu~ nea~ and sanitary at all times. The size of the <br /> active face on which municipal waste is being currently deposited <br /> shall be kept to a minimum. <br /> <br />4 <br /> <br /> <br />
