Motion carried. Voting Yes: Vice Chairperson Johnson, Commissioners Van Scoy, Brauer,
Jeffrey, and Watson. Voting No: None. Absent: Chairperson Nixt and Commissioner
Shepherd.

Commission Business

Commissioner Brauer indicated he is concerned about the river area. He asked if the Scenic
River laws would protect the City from having to allow a ten-story condo building.

Community Development Director Frolik indicated it would. She stated anything that went up
would have to be a PUD and be approved by the DNR and Mn/Dot. She indicated they are
currently updating the ordinance with new regulations, and have a lot of control.

Commissioner Brauer confirmed that if the density was too heavy along the river, they would be
able to deny a request.

Commissioner Van Scoy asked if the proposed nursing care facility would be deemed residential
or commercial.

Community Development Director Frolik stated she thinks it would be considered more
residential than commercial, and applied toward the 70% residential requirement.

Motion by Commissioner Van Scoy, seconded by Commissioner Jeffrey, to recommend that City
Council adopt a resolution approving the change the Comprehensive Plan from Low Density
Residential to Mixed Use.

Motion carried. Voting Yes: Vice Chairperson Johnson, Commissioners Van Scoy, Jeffrey,
Brauer and Watson. Voting No: None. Absent: Chairperson Nixt and Commissioner Shepherd.

Case #7

Request for Sketch Plan Approval of LeTendre Addition; Case of Robert
LeTendre

Community Development Director Frolik advised that Robert Letendre and Theresa Weibe are
requesting sketch plan approval to re-plat two existing homesteads into a total of three lots. She
noted the property is located at 17120 Tiger Street NW. She stated Mr. Letendre owns a 17 acre
parcel, where his single family home is located, and his daughter's home is located on the
adjacent 2.5 acre parcel to the south. Mr. Letendre is proposing to re-plat the two homesteads to
create a new 3 acre parcel for development. She advised the resulting lot sizes are 2.5 acres, 3
acres, and 14.2 acres. She further advised the subject property has a total of 579 feet of frontage
on Tiger Street; which results in a 21 foot deficiency in the 600 feet of frontage that would be
required for three lots.

Community Development Director Frolik stated the Board of Adjustment granted a variance to
create a new buildable lot with less than the 200 feet of frontage per lot on Tiger Street
contingent upon the Applicants including Lot 3, Block 1, Tranby Terrace 2nd Addition in the re-

Planning Commission/November 6, 2003
