Chair — copy our attorneys <br />because we have a signed Memo of Understanding with regard to officially mapping the <br />corridor. <br />4) Sign Phase I layout with our own condition that says we do not agree with their <br />conditions. <br />5) And — the most aggressive one is to actually litigate this. <br />Councilmember Elvig stated his preference would be to not knuckle under one iota — even if it <br />comes to litigation. <br />Councilmember Wise stated he would be surprised if we do not have landowners on Highway <br />#10 that would file a class action suit against the County, City and State because they have not <br />been able to do anything with their property. <br />Councilmember Jeffrey agreed with that. We have millions of dollars in taxpayer's money that <br />will not go back into the pool and the new administration needs to hear that. He added he is not <br />willing to back off. <br />Councilmember McGlone asked at what point we would say enough is enough. He added he is <br />okay with everything but the cut off. We could easily build tax base on Highway 10. <br />Councilmember Elvig asked when we stop this — when courts tell us we are out of line. <br />Mayor Ramsey stated that maybe the City could keep the tax base and get money back from <br />RALF monies. It would be premature to make any decisions now; we ought to have this <br />conversation three months from now. <br />Councilmember Jeffrey thought that maybe now is a good time to say to the new people that we <br />really need to look at this. <br />City Administrator Ulrich recommended we put together our argument of why the TPP should be <br />in support of our three interchanges and make MnDOT aware of that. Hint at litigation but that's <br />not the first step; we need to get some reversal on this. <br />Mayor Ramsey added they would work east to west. <br />Mayor Ramsey stated he is okay with sending a letter from the Mayor and Chair to Abeler and <br />Jungbauer, etc. and copy the attorneys — but to delay for three months and explore special <br />legislation. <br />Councilmember Wise asked about contacting other private property owners. <br />Mayor Ramsey stated that before we bring in senators, etc. we have to make sure we are hand in <br />hand with the County. <br />City Council Work Session — March 29, 2011 <br />Page 8 of 11 <br />
