RECIPROCAL FIRE SERVICE AGREKMENT <br /> <br />THIS AGREEMENT, by and between the City of Elk River and the City of <br />Ramsey said parties being municipal corporations of the State of <br />Minnesota. <br /> <br /> WHEREAS, each municipality desires to make available to the other <br />its fire-fighting equipment and personnel in cases of emergency and each <br />municipality has legal authority to send its fire-fighting equipment and <br />personnel into other communities. <br /> <br />NOW THEREFORE, IT IS MUTUAIJ,Y AGREED AS FOIJ~)WS: <br /> <br />1. If one or more fires occur within the limits of either of the above <br />municipalities, or within the limits of any territory in which either of said <br />municipalities have a contract to furnish fire-fighting equipment and <br />personnel, and the fire fighting equipment or personnel of the respective <br />municipality, in the judgment of the chief of its fire department or in his <br />absence his assistant or deputy in charge of its fire department, is <br />insufficient to control or extinguish the fire or fires, an "emergency" shall <br />exist for the purpose of this agreement. <br /> <br />2. If any emergency arises, any of the persons who are entitled by <br />paragraph I to determine an emergency may call upon the fire department <br />of the other municipality for assistance. <br /> <br />3. Upon receipt of a call for assistance as set forth in paragraph 2, the <br />fire department of the other party shall promptly dispatch at least one fire <br />truck with the usual number of personnel to assist in fighting the fire <br />which has caused the emergency or to render stand-by service as the case <br />may be, provided that neither fire department shall be obligated to send its <br />fire equipment or personnel beyond its boundaries if to do so would leave <br />that municipality without any fire equipment or personnel available within <br />its limits for service at any existing fire or fire which might subsequently <br />arise therein. In extreme emergencies, however, every effort will be made <br />to redistribute fire-fighting equipment and personnel so as to make them <br />available for any additional fires which might arise during the emergency. <br /> <br />4. The fire-fighting equipment and personnel of a fire department <br />assisting the fire department of the other municipality in an emergency <br />veil] immediately upon arrival at the scene of the emergency be under the <br />command of the officer in charge for the municipality within which the <br />emergency has arisen. <br /> <br />5. Upon assistance rendered during September 1, 1990 through <br />December 31, 1990 to the other party under this agreement a charge for <br />such assistance will be made in the amount of $300.00 per call for <br />assistance. No charge will be made by either party for assistance rendered <br />to the other party under this agreement from January 1, 1991 and <br />thereafter. <br /> <br />Fire Service Agreement Page 1 of 2 <br /> <br /> <br />
