AND NORTH <br /> <br />FORK, INC. <br /> <br />It is the intent of this grading and excavating to create a man-made lake with approximately 32 <br />acres of surface and to a depth approximately six feet deep. This conditional use permit is intended <br />,o supercede the previous permit issued to L & G Rehbein, Inc. and North Fork, Inc. which was <br />issued to create a man-made lake of slightly larger scope on this same location. This grading and <br />excavating permit shall apply to an area designated as portions of Outlot A and Lots 1 through 13, <br />Block 4, of the preliminary plat of Northfork 5th Addition. <br /> <br />This conditional use permit is issued pursuant to Section 9.11.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />All excavation shall be completed no later than July 31, 1992. All restoration shall be <br />completed by September 30, 1992. <br /> <br />In so far as possible, excavation at any one time shall be confined to a single area not <br />greater than 5 acres. <br /> <br />A haul route for material to be utilized on the adjacent golf course and exported off-site <br />shall be confined to a minimum width necessary to accommodate earth moving trucks. The <br />route of this path shall be defined as follows: <br /> <br />From the excavation site Southwesterly to the North right-of-way of the Burlington <br />Northern Railroad tracks, thence Southeasterly along said tracks to the intersection of <br />153rd Avenue N.W., thence Southwesterly along 153rd Avenue N.W. to the intersection <br />with U.S. Highway gl0. No other City streets other than the above specified portion of <br />153rd Avenue N.W. shall be utilized for hauling of excavated material or for the movement <br />of any earth moving equipment associated with the mining/grading operation. <br /> <br />Final grades shall conform to those identified on the "Pond Grading Plan Northfork Links" <br />Sheet 1 of 1, prepared by Probe Engineering Company, Inc. Intermediate construction <br />grades may not exceed 4 feet horizontal to 1 foot vertical at any time after working hours <br />when such grade would terminate into free-standing surface water. <br /> <br />The hours of grading and excavating operation shall be limited to between 6:30 a.m. and <br />8:00 p.m. Monday through Friday unless specifically otherwise approved by the City <br />Engineer. <br /> <br />The permittee shall promptly clean any spilled f'fll material which may be deposited on any <br />City street as a result of the mining and grading operation. <br /> <br />Operators shall utilize all practical means to reduce the amount of dust caused by the <br />operation. No operations shall be allowed when wind gusts exceed 30 mph. <br /> <br />The grading plan indicates that grading will need to be conducted within thirty feet of the <br />right-of-way of Andrie Street N.W. The purpose of grading within this thirty foot zone <br />shall be confined to acheiving the desired final grades of the building pads adjacent to <br />Andrie Street N.W. and for no other purpose. Work within this area shall be completed <br />and restored within the minimum time practical. <br /> <br /> <br />
